Application under the provisions of Section 439(2)<br \/>\nread with Section 482 of the Code of Criminal Procedure has been<br \/>\nfiled for cancellation of anticipatory bail granted to the<br \/>\nrespodnent-accused vide order below Exh. 9 dated  27.04.2011 passed<br \/>\nby the learend 3rd Additional Sessions Judge, Jamanagar in<br \/>\nCriminal Misc. Application No. 212 of 2011 whereby the<br \/>\nrespondent-accused was granted anticipatory bail in connection with<br \/>\nthe offence registered before the Jamnagar City &#8220;A&#8221;<br \/>\nDivision Police Station, Jamnagar being I-C.R. No. 55 of 2011 for the<br \/>\noffence punishable under Sections 447, 465, 467, 471 and 506(2) of<br \/>\nthe Indian Penal Code.\n<\/p>\n<p>2.0\tThe<br \/>\nfacts leading to the filing of the complaint is that the present<br \/>\ncomplainant who was residing at Indiranagar Road, Jamnagar had<br \/>\npurchased the plot No. 93-94 paiki bearing Revenue Survey No. 1351 by<br \/>\nway of sale-deed. The respondent-accused along with other co-accused<br \/>\nwhose name are mentioned in the F.I.R had illegally entered in to the<br \/>\nsaid plot and started construction of work of plinth level. As the<br \/>\ncomplainant tried to prevent them to do so, the accused had<br \/>\nadministered  threat of killing him by saying that they have<br \/>\npurchased the said plot. On inquiry, it was found by the complainant<br \/>\nthat both the plots were sold by way of bogus sale-deed by using the<br \/>\nsame as if they are true, correct and genuine documents.\n<\/p>\n<p>2.1\tUpon<br \/>\n F.I.R being filed, on apprehension of their arrest, the accused had<br \/>\npreferred anticipatory bail application being Criminal Misc.<br \/>\nApplication No. 212 of 2011 before the learned 3rd<br \/>\nAdditional Sessions Judge, Jamnagar. After hearing both the parties,<br \/>\nthe learned Judge granted the anticipatory bail to the<br \/>\nrespondent-accused vide order dated 27.04.2011 below Exh. 9 in<br \/>\nCriminal Misc. Application No.  212 of 2011.\n<\/p>\n<p>3.0\tBeing<br \/>\naggrieved by and dissatisfied with aforesaid order of granting<br \/>\nanticipatory bail to the respondent-accused, the applicant-State of<br \/>\nGujarat preferred the present Criminal Misc. Application.\n<\/p>\n<p>4.0\tLearned<br \/>\nAdditional Public Prosecutor Mr. K.P. Rawal appearing for the<br \/>\napplicant-State has submitted that the name of the respondent-<br \/>\naccused came to be revealed in the F.I.R from the inception and,<br \/>\ntherefore, it cannot be believed that accused persons are falsely<br \/>\nimplicated in the offence in question <\/p>\n<p>5.0\tLearned<br \/>\nAdditional Public Prosecutor further submitted that present<br \/>\nrespondent-accused with the other main accused persons illegally<br \/>\nentered into plot of complainant and thereby tried to make out<br \/>\nconstruction by way of showing them as purchaser by creating forged<br \/>\nand bogus documents of agreement to sell. The role of the present<br \/>\naccused persons is of creating forged and bogus documents as if they<br \/>\nare true, correct and genuine. Hence, the offence alleged against the<br \/>\naccused is of serious nature and their interrogation is required to<br \/>\nbe made.\n<\/p>\n<p>6.0\tLearned<br \/>\nAdditional Public Prosecutor further submitted that investigation has<br \/>\nbeen going on, statement of the witnesses are yet to be recorded and<br \/>\nthe relevant aspect that how the accused persons got two documents of<br \/>\nagreement to sell to be investigated, the learned Judge ought not to<br \/>\nhave granted anticipatory bail to the accused.\n<\/p>\n<p>7.0\tLearned<br \/>\nAdvocate appearing on behalf of the respondent- accused submitted<br \/>\nthat by recent amendment in law, in such type of alleged offence, the<br \/>\npolice cannot arrest the accused persons. The accused is ready to<br \/>\nremain present before police and Hon&#8217;ble Court on each date of<br \/>\nproceedings. But the police wish to arrest respondent violating the<br \/>\nclear provisions of the law and mandate of law, and, therefore, this<br \/>\napplication for cancellation of bail granted to the<br \/>\nrespondent-accused may be dismissed.\n<\/p>\n<p>8.0\tLearned<br \/>\nAdvocate appearing for the respondent has further submitted that the<br \/>\nco-accused persons who have filed application for anticipatory bail<br \/>\nbeing Criminal Misc. Application No. 118 of 2011 in the Sessions<br \/>\nCourt have been granted the anticipatory bail on the ground of<br \/>\nparity.\n<\/p>\n<p>9.0\tI<br \/>\nhave considered the rival submissions made by learned Advocates for<br \/>\nthe parties and also carefully gone through the order dated<br \/>\n27.04.2011 passed by the learned 3rd Additional Sessions<br \/>\nJudge, Jamnagar in Criminal Misc. Application No. 212 of 2011 in<br \/>\nlight of the documentary evidence forthcoming on the record. The<br \/>\npresent respondent is shown as original accused No.5 in the complaint<br \/>\nfiled by the complainant which has been registered vide I C.R. No. 55<br \/>\nof 2011 before the Jamnagar City &#8220;A&#8221; Division Police<br \/>\nStation, Jamnagar. The present respondent- Bansi Babubhai Gajjar<br \/>\nappears to have sold the land in dispute to Arjan Natha Gojiya. Then<br \/>\nit has been sold to Deva Sidi Keshvala. Deva Sidi Keshvala sold it to<br \/>\nKhima Naga Chhaaiya and from Khima Naga Chhaiya it was purchased by<br \/>\none of the accused Ala Bhimsi by registered sale-deed dated<br \/>\n24.06.2010. The complainant appears to have purchased the said land<br \/>\nwhich is in dispute subsequent to the earlier sale-deed from the<br \/>\nheirs of Mohan Kadva i.e. from Ramesh Mohan who is the son of Mohan<br \/>\nKadva on 30.09.2010 through registered sale-deed. In my view, the<br \/>\ndispute appears between the parties can be resolved by the Civil<br \/>\nCourt. It is not denied by the learned Additional Public Prosecutor<br \/>\nthat the co-accused persons who have filed Criminal Misc. Application<br \/>\nNo. 118 of 2011 before the trial Court for anticipatory bail had been<br \/>\ngranted. All these<br \/>\naspects have been considered by the learned Sessions Judge and in my<br \/>\nview, the discretion exercised by the learned Sessions Judge appears<br \/>\nto be correct.  For cancellation of bail, conduct subsequent to<br \/>\nrelease on bail and the supervening circumstances are relevant to be<br \/>\nlooked into.  To me there appears no overwhelming circumstance which<br \/>\nwarrants cancellation of the bail order passed by the trial court.\n<\/p>\n<p>10.0<br \/>\nThis<br \/>\nCourt is of the view that the learned Trial Judge has considered all<br \/>\nrelevant parameters while granting anticipatory bail to the<br \/>\nrespondent. On behalf of the applicant, nothing has been indicated to<br \/>\nshow that the respondent has, in any manner, misused the liberty<br \/>\ngranted to him.  In the circumstances, no case is made out for<br \/>\ncancellation of the anticipatory bail granted to the respondent.  The<br \/>\napplication, being devoid of merits, is accordingly rejected.
