Justice S.S.SATHEESACHANDRAN\n\n Dated :16\/10\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.29318 OF 2009\n           --------------------------\n     Dated this the 16th day of October 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>        The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<p>        i)   Issue a direction or order directing<\/p>\n<p>the Munsiff Court, Varkala to issue, a certified<\/p>\n<p>copy of the order, dismissing the application in<\/p>\n<p>Order  IX  Rule   13  (I.A.  No.1265\/2009  in   O.S<\/p>\n<p>No.319\/2005), applied for vide Copy Application C.A<\/p>\n<p>No.787\/2009 dated 08\/10\/2009 and a certified copy<\/p>\n<p>of  the  order,  dismissing  Exts.P2,  P3  and   P4<\/p>\n<p>petitions(E.A No.96\/2009, E.A No.95\/2009 and E.A<\/p>\n<p>No.114\/2009 in E.P No.5\/2007 in O.S No. 319\/2005),<\/p>\n<p>applied for vide Copy Application C.A No.786\/2009<\/p>\n<p>dated  08\/10\/2009,  as  expeditiously as   possible<\/p>\n<p>within a time frame to be fixed by this Hon&#8217;ble<\/p>\n<p>Court, and until the issuance of the orders, stay<\/p>\n<p>W.P.(C).No.29318 OF 2009    Page numbers<\/p>\n<p>all further execution proceedings in E.P No.5\/2007<\/p>\n<p>in O.S No.319\/2005 on the file of the Munsiff<\/p>\n<p>Court, Varkala for a reasonable period so that the<\/p>\n<p>petitioner can work out her remedies against the<\/p>\n<p>dismissal of the above mentioned petitions.<\/p>\n<p>          ii)     Issue such other appropriate writ,<\/p>\n<p>direction or order as the case may be in the facts<\/p>\n<p>and circumstances.\n<\/p>\n<\/p>\n<p>          2.    Petitioner is one among the judgment<\/p>\n<p>debtors in O.S No. 319 of 2005       on the file of the<\/p>\n<p>Munsiff Court, Varkala.        In the above suit, an<\/p>\n<p>exparte    decree    for recovery   of  possession  was<\/p>\n<p>granted in favour of the respondents.        Petitioner<\/p>\n<p>has applied for setting aside the exparte decree<\/p>\n<p>with a petition to condone delay, and also resisted<\/p>\n<p>the execution of the decree filing some petitions.<\/p>\n<p>The grievance canvassed is, all those petitions<\/p>\n<p>were dismissed without any enquiry and the delivery<\/p>\n<p>of the property has been ordered to be given effect<\/p>\n<p>to on 19\/10\/2009.        Petitioner has applied for<\/p>\n<p>W.P.(C).No.29318 OF 2009    Page numbers<\/p>\n<p>getting copies of the orders passed by the court,<\/p>\n<p>and in case, delivery is effected without providing<\/p>\n<p>her an opportunity to challenge the orders, it will<\/p>\n<p>cause her severe hardship and irreparable injury is<\/p>\n<p>the submission of the counsel.         Having regard to<\/p>\n<p>the submissions made and taking note of the facts<\/p>\n<p>and circumstances presented, I direct the court<\/p>\n<p>below to issue copies of the orders applied for<\/p>\n<p>under C.A No.787\/2009 and C.A No.786\/2009 within<\/p>\n<p>two weeks from the date of this judgment.           The<\/p>\n<p>execution court is directed to keep in abeyance the<\/p>\n<p>delivery for a period of three weeks from today.<\/p>\n<p>Writ petition is disposed subject to the above<\/p>\n<p>directions.
