PATEL - Applicant\n \n\nVersus\n \n\nSTATE\nOF GUJARAT - Respondent\n \n\n====================================== \nAppearance\n: \nMR\nGIRISH D CHAVDA for Applicant. \nMR KP RAVAL, APP for\nRespondent. \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/07\/2011 \nORAL ORDER<\/pre>\n<p>Learned<br \/>\n\tcounsel for the applicant submitted that while previously disposing<br \/>\n\tof the bail application of this applicant as not pressed, it was<br \/>\n\tprovided in the order dated 27.01.2011 that trial be expedited.  He<br \/>\n\tsubmitted that though the charge was framed on 18.12.2010, so far,<br \/>\n\ttrial has not been completed.   He submitted that majority of the<br \/>\n\twitnesses cited in the charge-sheet have already been examined, the<br \/>\n\tprosecution has given further list of witnesses which the Court<br \/>\n\tshould summon for examination during trial.  He pointed out that<br \/>\n\tsaid application is also granted.  In short, he pointed out that the<br \/>\n\ttrial is unlikely to be over shortly.\n<\/p>\n<p>Learned<br \/>\n\tcounsel further submitted that investigation is over and<br \/>\n\tcharge-sheet is filed.  The applicant is in jail since 17.08.2010.<br \/>\n\tHe has no criminal antecedents.\n<\/p>\n<p>Considering<br \/>\n\tthe above aspects of the matter, the applicant is released on bail<br \/>\n\tin connection with C.R.No. M  Case No.1 of 2009 registered with<br \/>\n\tViramgam Rural Police Station on furnishing bond of Rs.20,000\/-<br \/>\n\t(Rupees twenty thousand only) with one surety of the like amount to<br \/>\n\tthe satisfaction of the lower Court and on conditions that he shall<br \/>\n\t:\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before Viramgam Rural Police Station on every 1st<br \/>\n\tand 15th day of English Calender month between  11.00<br \/>\n\ta.m. And 2 p.m .\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
