Mr.Maulik G.Nanavati, learned Assistant<br \/>\nGovernment Pleader, waives service of notice for respondent No.2. On<br \/>\nthe facts and in the circumstances of the case and with the consent<br \/>\nof the learned counsel for the respective parties, the petition is<br \/>\nbeing heard and finally decided, today.\n<\/p>\n<p>2.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;(A)\tquash<br \/>\nand set aside the decision of the Gujarat Public Service Commission<br \/>\nas contained in Annexure-A to this petition, whereby, the candidature<br \/>\nof the petitioner is rejected for recruitment on the post of<br \/>\nAssistant Conservator of Forests\/ Range Forest Officer, Class-II and<br \/>\nfurther be pleased to declare and hold that the petitioner is<br \/>\neligible to be considered for appointment on the said post pursuant<br \/>\nto the advertisement No:209\/ 2009-10, Annexure-B to this petition,<br \/>\nissued by the Gujarat Public Service Commission, and<\/p>\n<p>(B)\tfurther<br \/>\nbe pleased to direct the Gujarat Public Service Commission to accept<br \/>\nthe candidature of the petitioner for recruitment on the post of<br \/>\nAssistant Conservator of Forests\/Range Forest Officer, Class-II, and<\/p>\n<p>(C)\tfurther<br \/>\nbe pleased to direct the Gujarat Public Service Commission to<br \/>\nconsider the case of the petitioners on merits alongwith the other<br \/>\neligible candidates, and<\/p>\n<p>(D)\taward<br \/>\nthe cost of petition, and<\/p>\n<p>(E)\tpending<br \/>\nadmission and final disposal of this petition, the Honourable Court<br \/>\nmay be pleased to direct the authorities of Gujarat Public Service<br \/>\nCommission to permit the petitioner to participate in the selection<br \/>\nprocess for recruitment on the post of Assistant Conservator of<br \/>\nForests\/ Range Forest Officer, Class-II, subject to further orders<br \/>\nthat may be passed in this petition, and<\/p>\n<p>(F)\tgrant<br \/>\nany other relief or pass any other order which the Honourable Court<br \/>\nmay consider as just and proper in the facts and circumstances of the<br \/>\ncase.&#8221;\n<\/p>\n<p>3.\tBriefly<br \/>\nstated, the case of the petitioner is that he had made an application<br \/>\nfor being considered for the post of Assistant Conservator of<br \/>\nForests\/ Range Forest Officer, Class-II, pursuant to the<br \/>\nadvertisement No.209\/2009-10, which was published in the newspaper on<br \/>\n1.3.2010. It is stated that the preliminary examinations were held on<br \/>\n30.5.2010, in which the petitioner had appeared successfully. The<br \/>\nmain examinations are to be held on 19.2.2011. However, the name of<br \/>\nthe petitioner appears on the list of &#8216;Ineligible Candidates&#8217; on the<br \/>\nground that a copy of the degree certificate of the petitioner was<br \/>\nnot submitted by him at the relevant point of time. Aggrieved by the<br \/>\naction of the respondent No.1 in considering the petitioner as being<br \/>\nineligible to appear in the final examination, he has approached this<br \/>\nCourt by filing the present petition.\n<\/p>\n<p>4.\tAt<br \/>\nthe very outset, Mr.Kamal Sojitra, learned advocate for Mr.Vaibhav A.<br \/>\nVyas, learned counsel for the petitioner, states that the interest of<br \/>\njustice would be met, if the representation dated 3.2.2011<br \/>\n(Annexure-E) made by the petitioner is directed to be considered by<br \/>\nrespondent No.1 before the commencement of the final examination.\n<\/p>\n<p>5.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>\tRespondent<br \/>\nNo.1 is directed to consider the representation dated 3.2.2011<br \/>\n(Annexure-E) made by the petitioner on, or before, 15.2.2011.\n<\/p>\n<p>\tThe<br \/>\ndecision shall be made in accordance with law and in proper<br \/>\nperspective.\n<\/p>\n<p>\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tDirect<br \/>\nService of this order, today, is permitted.\n<\/p>\n<p>(Smt.\n<\/p>\n<p>Abhilasha Kumari, J.)<\/p>\n<p>~gaurav~<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Rajesh vs Gujarat on 11 February, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
