RAVIKUMAR, JJ.\n                    ---------------------------------------------\n                        W.P.(C) NO. 23757 OF 2009\n                    ---------------------------------------------\n                   Dated this the 25th day of August, 2009\n\n\n                                  JUDGMENT\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>      The Writ Petition is filed with the following prayers:\n<\/p>\n<blockquote><p>            i. to issue a writ in the nature of Mandamus or<br \/>\n                such    other     writ,    order      or    direction,<br \/>\n                commanding respondents 2 to 5 to afford<br \/>\n                adequate and meaningful protection to the<br \/>\n                petitioners and their employees to conduct<br \/>\n                T.S. No. 24\/09-10 in Building No.XIII\/274 in<br \/>\n                Sy. No. 389\/11\/1\/2 of Kuthiyathode Village<br \/>\n                without     any    obstruction      from     the   6th<br \/>\n                respondent or his followers;\n<\/p><\/blockquote>\n<blockquote><p>            ii. to issue a writ in the nature of Mandamus or<br \/>\n                such other writ, order or direction, directing<br \/>\n                the police to afford sufficient protection to the<br \/>\n                life and property of petitioners and their<br \/>\n                workers attached to T.S. No.24\/09-10 while<br \/>\n                conducting the said toddy shop in its<br \/>\n                scheduled premises.\n<\/p><\/blockquote>\n<p>      2. The 6th respondent has filed a counter affidavit. In paragraph 3 of<\/p>\n<p>the counter affidavit, it is stated as follows:\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C)NO.23757\/2009                  2<\/span><\/p>\n<blockquote><p>                  &#8220;It is true that the 6th respondent and<br \/>\n           others had raised objections before the Excise<br \/>\n           authorities on the ground that the location of<br \/>\n           the shop is within the prohibited distance.<br \/>\n           Though the petitioners       were afforded ample<br \/>\n           opportunities to locate an unobjectionable site,<br \/>\n           they are bent upon disturbing the 6th respondent<br \/>\n           and others by insisting the running of the Toddy<br \/>\n           shop at the disputed place. Naturally therefore,<br \/>\n           there is opposition.      However, no Law and<br \/>\n           Order situation exists.        Nor is there any<br \/>\n           unlawful     obstruction    caused   by   the   6th<br \/>\n           respondent and others at any time. The alleged<br \/>\n           threat etc., are totally false. The attempt of the<br \/>\n           petitioners is to silence any objection to the<br \/>\n           unauthorized running of a shop, licence to<br \/>\n           which was obtained at a time when there was a<br \/>\n           stay from this Hon&#8217;ble Court. Since there is no<br \/>\n           law and order situation there had been no failure<br \/>\n           on the part of the police. This respondent and<br \/>\n           other peace loving citizens of the locality have<br \/>\n           every right to object to the running of the Toddy<br \/>\n           shop, which will pose danger to the women-folk<br \/>\n           for a peaceful living in the area. Apart from<br \/>\n           raising such objections there is no conduct that<br \/>\n           can be called culpable, illegal or objectionable<br \/>\n           from the side of the 6th respondent or others.&#8221;\n<\/p><\/blockquote>\n<p>The above submissions are recorded.         It is made clear that the 6th<\/p>\n<p>respondent shall not take law in his hands so as to interfere with the<\/p>\n<p>lawful conduct of the toddy shop.\n<\/p>\n<p>     Therefore, recording the submissions as extracted above and with<\/p>\n<p>the above clarification, the Writ Petition is disposed of , making it clear<\/p>\n<p><span class=\"hidden_text\">W.P.(C)NO.23757\/2009                 3<\/span><\/p>\n<p>that in case there is any unlawful    obstruction on the part of the 6th<\/p>\n<p>respondent or his henchmen, it will be open to the petitioners to bring the<\/p>\n<p>same to the notice of respondents 4 and 5, in which case appropriate<\/p>\n<p>action, in accordance with law, will be taken by the police to ensure that<\/p>\n<p>law and order is maintained.\n<\/p>\n<p>                                   (KURIAN JOSEPH)<br \/>\n                                           JUDGE<\/p>\n<p>                                    (C.T.
