            These two revisions arise from two separate<\/p>\n
orders passed by the transferee execution court, Sub<\/p>\n
Court, Thalassery holding that the decrees transferred to<\/p>\n
that court for execution are inexecutable. The decree<\/p>\n
holders, who have moved for execution of the decree<\/p>\n
and, later, got it transferred to the above court since the<\/p>\n
judgment debtors are stated to be having properties<\/p>\n
within the jurisdiction of that court, aggrieved by the<\/p>\n
orders passed by the Sub Court, Thalassery, as indicated<\/p>\n
above, have filed these revisions.<\/p>\n
            2. Though the decree holders are different,<\/p>\n
since common questions of law and facts are involved<\/p>\n
and as the judgment debtors in both the proceedings are<\/p>\n
common, these revisions are disposed of under this<\/p>\n
common order.\n<\/p>\n

                          :: 2 ::\n<\/p>\n<\/p>\n
           3. I heard the counsel on both sides.<\/p>\n
           4.   From the submissions made and also<\/p>\n
perusing the impugned orders passed by the learned Sub<\/p>\n
Judge, Thalassery, it is seen that the decrees had been<\/p>\n
passed against one Pandan Krishnan, who is no more.<\/p>\n
The decrees are now being sought to be executed<\/p>\n
against his legal representatives, his wife and children.<\/p>\n
           5. The learned counsel for respondents, the<\/p>\n
legal representatives of the above said Pandan Krishnan<\/p>\n
contend that the decrees had been passed not against<\/p>\n
Pandan Krishnan in his individual capacity, but as the<\/p>\n
Managing Director of a company.             So much so,<\/p>\n
execution against the judgment debtors and their<\/p>\n
properties was objected to before the transferee court,<\/p>\n
and on the materials placed and construing the decree<\/p>\n
that had been passed, the objection was upheld by the<\/p>\n
learned Sub Judge, according to the learned counsel. No<\/p>\n

\ninterference with the orders so passed by the transferee<\/p>\n
court to which the decree had been transferred, in the<\/p>\n
given facts of the case, is called for, is the submission of<\/p>\n
the learned counsel for the respondents.<\/p>\n
             6. To what extent the transferee court can go<\/p>\n
into the objections canvassed against the executability of<\/p>\n
the decree raised by the judgment debtors is the<\/p>\n
question that emerge for consideration in the present<\/p>\n
case. This Court in Ramankutty v. Kali Nani {1986 KLT<\/p>\n
54} analysing Sections 42 and 39 of the Code of Civil<\/p>\n
Procedure, which are applicable for resolving the<\/p>\n
question has held thus:\n<\/p>\n
             “The transferee court is not vested with any<\/p>\n
      jurisdiction under S.42 C.P.C. to review the order of<\/p>\n
      the transferor court or reconsider it on any grounds.<\/p><\/blockquote>\n
      If the judgment debtor wants to review it he should<\/p>\n
      approach the court which passed the decree. S.42 of<\/p>\n
      the CPC itself makes it clear that the transferee court<\/p>\n

                            :: 4 ::\n<\/p>\n
\n     is empowered to execute the decree sent to it by the<\/p>\n
     transferor court and as Order 21 Rule 26 gives<\/p>\n
     power to the transferee court to stay the execution<\/p>\n
     of such decree for a reasonable time to enable the<\/p>\n
     judgment debtor to apply to the court which passed<\/p>\n
     the decree for an order of stay the position admits of<\/p>\n
     no doubt that the transferee court is not vested with<\/p>\n
     full powers as if the transferor court has lost its<\/p>\n
     seisin over the matter.”\n<\/p>\n
            7. Perusing the impugned orders, it is seen<\/p>\n
that the transferred court in the present case on the<\/p>\n
basis of the promissory note and also such other<\/p>\n
materials which gave rise to the decree sent over for<\/p>\n
execution had formed some conclusions with respect to<\/p>\n
the executability of the decree which in fact was outside<\/p>\n
its domain.   In fact if the legal representatives of the<\/p>\n
judgment debtor have any tenable objection to the<\/p>\n
executability of the decree against them, whether it be<\/p>\n
passed against Pandan Krishnan in his personal capacity<\/p>\n

                          :: 5 ::\n<\/p>\n
\nor in his capacity as the Managing Director of the<\/p>\n
Company, such objections could be canvassed against<\/p>\n
the executability of the decree only before the transferor<\/p>\n
court. It is open to the legal representatives to seek for<\/p>\n
stay of the proceedings by the transferee court for a<\/p>\n
reasonable period as provided under Rule 26 of Order 21<\/p>\n
of the Code of Civil Procedure to raise their objections<\/p>\n
whatever that be, against the executability before the<\/p>\n
transferor court which transferred the decrees.       The<\/p>\n
orders impugned in these revisions passed by the<\/p>\n
transferee court are set aside and the transferee court is<\/p>\n
directed to dispose of the matter in accordance with law,<\/p>\n
subject to providing reasonable opportunity to the<\/p>\n
judgment debtors,     if any application is moved under<\/p>\n
Order 21 Rule 26 Code of Civil Procedure for stay of the<\/p>\n
proceedings, to raise their objections before the<\/p>\n
transferee court, as provided by law.<\/p>\n
