WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.  We have  heard learned  counsel on both<br \/>\nsides.\n<\/p>\n<p>     This appeal  by special  leave arises form the judgment<br \/>\nof the\tDivision  Bench,  made\ton  September  12,  1996  in<br \/>\nL.P.A.No.215\/1979  by\tthe  Delhi  High  Court.  While\t the<br \/>\nrespondent was working as a cash clerk in Delhi Milk Scheme,<br \/>\ntemporary Mis-appropriation  of the  funds on  more than one<br \/>\noccasion   was\t  discovered.\tWhen   misappropriation\t  of<br \/>\nRs.17,744,91 on April 2,1972 was reported, a prosecution was<br \/>\npending, orders\t were passed  by the  competent authority on<br \/>\nApril 24, 1972 as under :\n<\/p>\n<blockquote><p>     &#8220;In pursuance  of\tthe  proviso  to<br \/>\n     sub-rule  (1)  of\tRule  5\t of  the<br \/>\n     Central Civil  services  (Temporary<br \/>\n     Services)\tRules.\t1965,  I  hereby<br \/>\n     terminate forthwith the services of<br \/>\n     Shri  B.L.\t  Sidhana,  Case   clerk<br \/>\n     (under  suspension),   Delhi   milk<br \/>\n     scheme and\t direct that he shall be<br \/>\n     paid a  sum equivalent  to the  one<br \/>\n     equivalent to the amount of pay and<br \/>\n     allowances fr  a period  of notice)<br \/>\n     was drawing them immediately before<br \/>\n     the date  on which\t he was\t drawing<br \/>\n     them immediately  before the  dated<br \/>\n     on\t which\t he  was   placed  under<br \/>\n     suspension.&#8221;<\/p><\/blockquote>\n<p>     The respondent  was acquitted  of\tthe  charge  in\t the<br \/>\ncriminal case  and therefore,  he filed\t a writ petition. In<br \/>\nhis order, the learned single Judge held thus :\n<\/p>\n<blockquote><p>     &#8220;The petition  of Cash Clerk is one<br \/>\n     of confidence  and\t responsibility.<br \/>\n     Even  if\tthe  incidents\t averred<br \/>\n     against  the  petitioner  were  not<br \/>\n     proved, they  were such, as to lead<br \/>\n     a prudent employer to terminate the<br \/>\n     services\tof   the   employer   to<br \/>\n     terminate\tthe   services\tof   the<br \/>\n     employee on  the ground of his, not<br \/>\n     being  desirable.\t The  order   of<br \/>\n     termination was  passed, as noticed<br \/>\n     above, one\t year after the criminal<br \/>\n     case  had\tstarted\t and  two  years<br \/>\n     after  the\t  enquiry.  The\t enquiry<br \/>\n     appears not to have been completed,<br \/>\n     so, no  definite opinion  had  been<br \/>\n     arrived as with regard to the guilt<br \/>\n     of\t  the\tpetitioner.   No.   evil<br \/>\n     consequences were\tvisited\t on  the<br \/>\n     termination. No.  evil consequences<br \/>\n     were visited  on the  petition as a<br \/>\n     result of the order of termination.<br \/>\n     Nor has  any stigma  been attached.<br \/>\n     No. penalties were inflicted on the<br \/>\n     petitioner despite\t the  enquiries,<br \/>\n     and the  started  of  the\tcriminal<br \/>\n     case.  In\t the  circumstances  the<br \/>\n     order of termination simpliciter is<br \/>\n     valid.   Since    the   order    is<br \/>\n     innocuous, there is no need to peer<br \/>\n     behind  it,  unless  malafides  had<br \/>\n     been established.&#8221;<\/p><\/blockquote>\n<p>     On appeal, the Division Bench reversed it, holding that<br \/>\nthe order  of removal  does indicate that it was termination<br \/>\nof the\tservices of  the respondent  with stigma attached by<br \/>\nmentioning (under  suspension). Rule  5(1)  of\tthe  central<br \/>\ncivil services\t(Temporary service) Rules, 1965 was exercise<br \/>\nwith stigma  attached in  the order. The order does indicate<br \/>\nthat he\t was under  suspension. It postulates that it was by<br \/>\nway of\ta misconduct  and  thereby  without  conducting\t the<br \/>\nenquiry, the  termination of  the service  of the respondent<br \/>\nwas illegal.  Consequently, instead  of reinstating him into<br \/>\nservice the court directed the appellant-employer to pay him<br \/>\ncompensation in\t a sum\tof Rs. 2.50 lakhs. Aggrieved by that<br \/>\norder, this appeal has been filed.\n<\/p>\n<p>     It\t is  true  that\t respondent  was  acquitted  by\t the<br \/>\ncriminal court\tbut acquittal  does not\t automatically gives<br \/>\nhim the\t right to  be reinstated into the services. It would<br \/>\nstill be  open to  the competent  authority to make decision<br \/>\nwhether the  delinquent Government servant can be taken into<br \/>\nservice or  disciplinary action\t should be  taken under\t the<br \/>\nCentral civil  services (Clarification,\t Control  &amp;  Appeal)<br \/>\nRules or under the Temporary services Rules. Admittedly, the<br \/>\nrespondent  had\t been  working\tas  a  temporary  Government<br \/>\nservant before he was kept under suspension. The termination<br \/>\norder indicated\t the factum  that he,  by  then,  was  under<br \/>\nsuspension. It is only a way of describing him a being under<br \/>\nsuspension when\t the order  came to  be passed but that does<br \/>\nnot constitute\tany stigma.  Mere  acquittal  of  Government<br \/>\nemployee  does\tnot  automatically  entitle  the  Government<br \/>\nemploye\t does\tnot  automatically  entitle  the  Government<br \/>\nservant to  reinstatement. As  stated earlier,\tit would  be<br \/>\nopen to\t the  appropriate  competent  authority\t to  take  a<br \/>\ndecision whether the enquiry into the conduct is required to<br \/>\nbe done before directive reinstatement of appropriate action<br \/>\nshould be taken as  per\t law, if otherwise, available. Since<br \/>\nthe respondent\tis only\t a temporary Government servant, The<br \/>\npower being  available under  Rules, it\t is  always  open  a<br \/>\ntemporary Government  servant,\tthe  power  being  available<br \/>\nunder rules, it is always open to the competent authority to<br \/>\ninvoke the  said power\tand terminate  the  service  of\t the<br \/>\nemploye instead\t of conducting\tthere enquiry or to continue<br \/>\nin service  a\tGovernment servant accused of defalcation of<br \/>\npublic money.  Reinstatement would  be a  charter for him to<br \/>\nindulge with impunity in misappropriating of public money.\n<\/p>\n<p>     Under these  circumstances, the  Division Bench  of the<br \/>\nHigh court  was clearly in error in directing payment of the<br \/>\ncompensation which amounts to premium for misconduct.\n<\/p>\n<p>     The appeal\t is accordingly allowed. The judgment of the<br \/>\nDivision Bench\tstands set  aside and  that of\tthe  learned<br \/>\nsingle Judge  stands confirmed.\t The  writ  petition  stands<br \/>\ndismissed.
