SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/08\/2008 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tPresent<br \/>\nAppeal from Order under Order XLIII Rule 1(r) of the Code of Civil<br \/>\nProcedure by the appellant ?  original plaintiff challenging the<br \/>\norder dated 24.07.2007 passed by the learned 7th<br \/>\nAdditional Civil Judge and J.M.F.C., Bhuj ?  Kutch below Exh.5 in<br \/>\nSpecial Civil Suit No.40 of 2007 by which the learned trial Court has<br \/>\ndismissed the application submitted by the appellant ?  original<br \/>\nplaintiff for interim injunction during pendency of the aforesaid<br \/>\nSpecial Civil Suit.\n<\/p>\n<p>2.\t\tPrima-facie<br \/>\nconsidering the fact that the appellant ?  original plaintiff is<br \/>\nclaiming decree for specific performance of Sathakat executed between<br \/>\nthe plaintiff and defendant No.1 and that defendant No.1 is not the<br \/>\nowner and defendant No.2 is the owner but has not executed agreement<br \/>\nto sale \/ Sathakat in favour of the appellant, it cannot be said that<br \/>\nthe learned trial Court has committed any error in refusing to grant<br \/>\ninterim injunction during pendency of the aforesaid Civil Suit and<br \/>\ndismissed application Exh.5. Hence, no interference of this Court is<br \/>\ncalled for. However, it is observed that whatever observations made<br \/>\nby the learned trial Court while deciding application Exh.5 should be<br \/>\nconstrued only while deciding application Exh.5 and the learned trial<br \/>\nCourt to decide and dispose of the aforesaid Suit in accordance with<br \/>\nlaw and on merits without in any way being influenced by the<br \/>\nobservations made in the impugned order passed below exh.5. With<br \/>\nthese, present Appeal from Order is dismissed.
