Vaishnav, learned<br \/>\nadvocate for the<br \/>\npetitioner,<br \/>\nhas filed a sick-note today. Yesterday also, he had filed a<br \/>\nsick-note. In view of the same, the matter is adjourned to<br \/>\n08th February 2010.\n<\/p>\n<p>\tIf<br \/>\nhe is not able to appear in the matter even on the next date, he<br \/>\nshall make an alternative arrangement for appearing in the matter.\n<\/p>\n<p>2.\tToday,<br \/>\nwhen the matter was called out in the first sessions, learned<br \/>\nadvocate for the petitioner requested to hear the matter in the<br \/>\nsecond sessions on the ground that he has to attend some matter,<br \/>\nwhich has been fixed for hearing today, by another Court. The Court<br \/>\naccepted the request made by Mr. Vaishnav and accordingly, kept back<br \/>\nthe same for hearing in the second sessions.\n<\/p>\n<p>3.\tHowever,<br \/>\nin the second sessions, when the matter was called out, learned<br \/>\nadvocate for the petitioner was not present. The aforesaid conduct of<br \/>\nthe learned advocate for the petitioner is nothing but, an attempt to<br \/>\nget an adjournment from this Court. Considering the fact that Mr.<br \/>\nVaishnav has consistently not remained present, this Court has no<br \/>\nother alternative but, to proceed with the matter on merits, in his<br \/>\nabsence.\n<\/p>\n<p>4.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed to quash and set aside the order dated<br \/>\n29.01.2005 passed by the appellate Committee of the respondent-Board<br \/>\nin Appeal No.103\/2004 in so far as it is against the petitioner as<br \/>\nalso the supplementary bill raising the demand of Rs.25,63,026.00; or<br \/>\nto direct the respondent-Board to consider the penalty factor of 1.5<br \/>\nand \/ or the load factor of 0.2 and to calculate the supplementary<br \/>\nbill accordingly; or to remand the matter to the appellate Committee<br \/>\nof the respondent-Board for deciding the same afresh.\n<\/p>\n<p>5.\tThe<br \/>\nfacts in brief are that the petitioner herein is a Consumer of the<br \/>\nrespondent-electricity company and has taken H.T. connection of 250<br \/>\nKVA for its factory premises. The agreement between the petitioner<br \/>\nand respondent-company was to expire in the year 2001. Before the<br \/>\nexpiry period, the petitioner had requested the respondent-Company to<br \/>\nreduce the contract load, which was, subsequently, reduced to 170 KVA<br \/>\nfrom 250 KVA.\n<\/p>\n<p>6.\tOn<br \/>\n17-18.08.2004 the inspection squad of the respondent visited the<br \/>\npremises of the petitioner and allegedly found certain<br \/>\nirregularities. In pursuance thereof, a bill of Rs.54,34,890\/- was<br \/>\nissued to the petitioner. Against the same, the petitioner preferred<br \/>\nan appeal before the appellate Committee of the respondent. After<br \/>\nhearing both the sides, the appellate Committee dismissed the appeal<br \/>\npreferred by the petitioner. Pursuant thereto, a supplementary bill<br \/>\nof Rs.49,13,790\/- was issued to the petitioner. Hence, this petition.\n<\/p>\n<p>7.\tHeard<br \/>\nlearned counsel for the respondents and perused the documents on<br \/>\nrecord. When the inspecting squad visited the premises of the<br \/>\npetitioner on 18.08.2004 for the purpose of replacing the CTPT unit,<br \/>\nit found the cables of the unit to be tampered with. The &#8216;R&#8217; phase<br \/>\nand &#8216;B&#8217; phase cables were shortened by providing extra chip in it.<br \/>\nThe aforesaid irregularity was noted down in the Rojkam, in<br \/>\npresence of the representative of the petitioner. The Laboratory<br \/>\ninspection report as also the M.R.I. proved the aforesaid<br \/>\nirregularities. On the basis of the aforesaid irregularties, the<br \/>\nappellate Committee of the respondent-Company recorded the finding<br \/>\nthat the petitioner had committed theft of electricity.\n<\/p>\n<p>8.\tLooking<br \/>\nto the facts and circumstances of the case and the materials on<br \/>\nrecord, I am of the opinion that the respondent-Company was<br \/>\ncompletely justified in dismissing the appeal preferred by the<br \/>\npetitioner and in issuing the supplementary bill in question and<br \/>\nhence, I find no reasons to interfere in this petition in exercise of<br \/>\npowers under Article 226 of the Constitution of India.\n<\/p>\n<p>9.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed.
