On February  12, 1990  the appellant  filed a complaint<br \/>\nagainst the  respondent No. 1 (respondent&#8217; for short) in the<br \/>\nCourt of  the Chief  Judicial Magistrate, Ernakulam alleging<br \/>\ncommission of an offence under Section 138 of the Negotiable<br \/>\nInstruments Act\t (&#8216;Act&#8217; for short). The sum and substance of<br \/>\nthe  various  allegations  made\t in  the  complaint  are  as<br \/>\nfollows:\n<\/p>\n<p>     On\t final\t settlement  of\t  accounts  of\tthe  various<br \/>\ncommercial  transactions   that\t took\tplace  between\t the<br \/>\nappellant and  the respondent,\tan amount  of Rs. 3,00,000\/-<br \/>\nwas found  due to  the former  from the\t latter. In  payment<br \/>\nthereof the  respondent issued\ta cheque  in favour  of\t the<br \/>\nappellant  which   on  presentation   was  dishonoured.\t The<br \/>\nappellant then sent a notice to the respondent demanding the<br \/>\namount but  it came  back unserved  with an endorsement that<br \/>\nthe was\t absent. Thereafter  another similar notice was sent<br \/>\nto and\tserved upon  the respondent  but he  did not pay the<br \/>\namount.\n<\/p>\n<p>3.   While  the\t  case\tarising\t  out  of   the\t appellant&#8217;s<br \/>\ncomplaint, (which  was registered  as case  No. C. C. 167 of<br \/>\n1990), was  awaiting disposal  the respondent,\tin his turn,<br \/>\nfiled a\t complaint against  the appellant  before  the\tsame<br \/>\nMagistrate, of alleged commission of offences under Sections<br \/>\n380, 465,  467, 468  and 471 I. P. C. The allegations in his<br \/>\ncomplaint were\tthat in the year 1985 when he went abroad he<br \/>\nentrusted three\t blank cheques\tof the\tState Bank of India,<br \/>\nShenmugnam Road Branch, Ernakulam, duly signed by him to his<br \/>\nwife to\t meet the  family expensed.  The appellant,  who had<br \/>\naccess to  the house  of  the  respondent,  dishonestly\t and<br \/>\nstealthily removed  one of  those cheques from his house and<br \/>\nutilised it  to\t institute  a  false  case  against  him  by<br \/>\ninserting his  (the appellant&#8217;s)  name as  the payee and the<br \/>\nsum of Rs. 3,00,000\/- as the amount to be paid thereunder.\n<\/p>\n<p>4.   The case  that arose  out of  the appellant&#8217;s complaint<br \/>\nended in  conviction of\t the respondent\t while that  of\t the<br \/>\nlatter in  discharge of\t the appellant under Section 245 (1)<br \/>\nCr. P. C.\n<\/p>\n<p>5.   Against his  conviction  and  sentence  the  respondent<br \/>\npreferred an  appeal in\t the  Court  of\t Session  which\t was<br \/>\nallowed and  he was acquitted. Assailing the above acquittal<br \/>\nthe appellant  filed an appeal before the High Court and the<br \/>\nrespondent filed  a revision  petition challenging the order<br \/>\nof discharge  passed in\t favour of  the appellant.  Both the<br \/>\nappeal and  the revision  petition were\t disposed of  by the<br \/>\nHigh Court  by a  common judgment  whereby  the\t High  Court<br \/>\nupheld the  order of  acquittal of the respondent, set aside<br \/>\nthe order of discharge passed in favour of the appellant and<br \/>\ndirected the  Chief Judicial  Magistrate to proceed with his<br \/>\ntrial in accordance with law. The above judgment of the High<br \/>\nCourt is  under challenge  in this appeal at the instance of<br \/>\nthe appellant.\n<\/p>\n<p>6.   Coming  first   to\t the   impugned\t acquittal   of\t the<br \/>\nrespondent we  notice that the Additional Sessions Judge and<br \/>\nthe High  Court recorded  a finding  that before filling the<br \/>\ncomplaint the  appellant did  not serve\t a notice within the<br \/>\nperiod prescribed  under Section  138 of  the Act. Since the<br \/>\nabove  finding\t is  one   of  fact   and  based  on  proper<br \/>\nappreciation of\t the evidence  no  interference\t in  respect<br \/>\nthereof is called for. However, the impugned judgment of the<br \/>\nHigh Court  so far  as it  set aside  the order of discharge<br \/>\npassed in favour of the appellant cannot be sustained for on<br \/>\nperusal of the record we find that the trial Court was fully<br \/>\njustified in  concluding that the evidence adduced on behalf<br \/>\nof the respondent was insufficient to make out a prima facie<br \/>\ncase against the appellant.\n<\/p>\n<p>7.   For the foregoing discussion, we quash the order of the<br \/>\nHigh Court  so far  as it  set aside  the discharge  of\t the<br \/>\nappellant  and\trestore\t the  order  of\t the  learned  Chief<br \/>\nJudicial  Magistrate,  Ernakulam  dated\t February  17,\t1992<br \/>\npassed in  C. C.  No. 229  of 1990.
