Sharma (Advocate), (hereinafter called the appellant) had filed an<br \/>\nRTI request dated 20.12.2008 seeking copies of file notings of action taken in the<br \/>\nlight of two legal notices dated 19.03.2008 and 14.07.2008 served for grant of<br \/>\ncentral pension to Sh. Tara Chand, Freedom Fighter, Bhiwani, Haryana by the<br \/>\nGovt. of India, and matters connected therewith. On not receiving a reply from<br \/>\nthe CPIO, M\/o Home Affairs, the appellant filed first appeal dated 27.01.2009<br \/>\nbefore the First Appellate Authority (FAA) \/Jt. Secretary (FFR) M\/o Home<br \/>\nAffairs. The FAA through his letter dated 6.03.2009 informed the appellant that<br \/>\nhis RTI application dated 20.12.2008 had not been received in the Freedom<br \/>\nFighters Division, M\/o Home Affairs, therefore no reply could be given, however,<br \/>\non receipt of a copy of the RTI application along with the First Appeal, the<br \/>\nministry has sent a letter to the State Govt. of Haryana on 13.02.2009, for<br \/>\nexamination of the request of Sh. Tara Chand and that the case of Sh. Tara Chand<br \/>\nfor grant of Samman Pension would be considered under the provisions of<br \/>\nSwatantrata Sainik Samman pension Scheme, 1980, on receipt of a report from the<br \/>\nState Govt. Not satisfied with the reply the appellant has filed a second appeal<br \/>\nbefore the Commission.\n<\/p>\n<p>   2.      The matter was heard on 12.01.2010<\/p>\n<p>   3.      The appellant was not present for the hearing\n<\/p>\n<p>   4.      Sh. A.K. Goyal, JS (FFR) MHA and Sh. O.M. Prakash, U.S. MHA<br \/>\n           represented the respondent<br \/>\n Decision<\/p>\n<p>       During the hearing the respondent submitted that the Ministry has since<br \/>\nreceived a letter dated 2.03.2009 from the Haryana Govt., found the claim was<br \/>\nexamined on the basis of documents and Sh.
