The learned advocate for the petitioner could not point<br \/>\nout that he has mentioned anything about hearing which was granted by<br \/>\nGCERT on 3rd September 2010 to the persons like the<br \/>\npetitioner, who had raised objections about the provisional seniority<br \/>\nlist dated 1st April 2010.\n<\/p>\n<p>The petitioner,<br \/>\nafter the seniority list was published on 7th September<br \/>\n2010, had filed representation  on 14th September 2010, a<br \/>\ncopy of that is produced at page 39. This representation was replied<br \/>\nby the Secretary, GCERT, Gandhinagar by letter dated 15th<br \/>\nSeptember 2010, wherein it is specifically mentioned that the<br \/>\nseniority list is prepared after taking into consideration the<br \/>\nrepresentation made by the persons like the petitioner, against the<br \/>\nprovisional seniority list dated 1st April 2010, for which<br \/>\npersonal hearing was granted on 3rd September 2010 before<br \/>\na Committee and it is only as per the decision taken by that<br \/>\nCommittee that the present seniority list is published.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner ought to have stated in the petition that, &#8216;earlier there<br \/>\nwas a provisional seniority list published on 1st April<br \/>\n2010. Objections were invited against the said seniority list.<br \/>\nThereafter, personal hearing was given on 3rd September<br \/>\n2010  by a Committee, before whom the petitioner or similarly<br \/>\nsituated persons had pointed out their objections, but then the same<br \/>\nare not considered by that Committee.  It is thereafter that as per<br \/>\nthe decision of that Committee, final seniority list is prepared&#8217;.<br \/>\nIn the present petition, not a word is mentioned about hearing given<br \/>\non 3rd September 2010, besides no mention is made about<br \/>\nthe contents of the representation made by the petitioner or person<br \/>\nsimilarly situated before that Committee, hence the petition cannot<br \/>\nbe  entertained. The same is dismissed on the ground of suppression<br \/>\nof material fact.\n<\/p>\n<p>3.\tAt this<br \/>\njuncture, learned advocate for the petitioner submitted that there<br \/>\nare other petitions filed by other persons against this very<br \/>\nseniority list being Special Civil Applications No.5173 of 2010 and<br \/>\n5174 of 2010, which are admitted. This submission does not help the<br \/>\npetitioner because there is nothing on record to show that there was<br \/>\nsuppression like the present petition, in those petitions also and<br \/>\nstill they are admitted.  In light of the aforesaid discussion, this<br \/>\npetition is dismissed.\n<\/p>\n<p>(RAVI<br \/>\nR.
