Respondents - Opposite Parties.\n\n\n                                     -----------\n<\/pre>\n<p>03\/   27.07.2010              Heard learned counsel for both the parties.<\/p>\n<p>                              This miscellaneous appeal is directed against the<\/p>\n<p>                   order dated 8th January, 2010 passed by the Ist Additional<\/p>\n<p>                   District    Judge-cum-Motor       Vehicle      Accident     Claim<\/p>\n<p>                   Tribunal, Gaya whereby the claim of the appellants<\/p>\n<p>                   regarding the death of Mahesh Choudhary has been allowed<\/p>\n<p>                   to the tune of Rs.4,08,000\/-.\n<\/p>\n<p>                              The grievance of the appellants is for enhancement<\/p>\n<p>                   of the compensation. However, it has come in evidence that<\/p>\n<p>                   Mahesh Choudhary was earning Rs.150-200 per day by<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>         selling toddy.\n<\/p>\n<p>                  Learned lower court, however, considered that the<\/p>\n<p>         toddy selling is a seasonal business and assessed his earning<\/p>\n<p>         Rs.100\/- per day at a flat rate for the entire year and held<\/p>\n<p>         that deceased Mahesh Choudhary had annual income of<\/p>\n<p>         Rs.36,000\/- per annum and thereafter considered to deduct<\/p>\n<p>         1\/3rd amount as personal expenditure and calculated the<\/p>\n<p>         compensation amount on taking Rs.24,000\/- as saving and<\/p>\n<p>         with a multiplier of 17 as he was 25 years old and hence has<\/p>\n<p>         well considered the every aspect for calculating the income<\/p>\n<p>         in fact and law. I do not find any illegality or irregularity in<\/p>\n<p>         calculating the compensation.\n<\/p>\n<p>                  However, having regard to the fact that the<\/p>\n<p>         compensation was calculated after taking into consideration<\/p>\n<p>         entire materials on record both on fact and law. I do not find<\/p>\n<p>         that there is any illegality or irregularity in calculating the<\/p>\n<p>         amount of compensation at a lower rate and therefore, no<\/p>\n<p>         case for enhancement of compensation is made out.<\/p>\n<p>                  The appeal has no merit and hence it is dismissed.<\/p>\n<pre>Kundan                          (Gopal Prasad, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Mostt.Sona Devi &amp;Amp; Ors. vs Smt.
