Radhakrishnan, J.\n<\/p>\n<p>     Petitioners claim that they were employed in one of the<\/p>\n<p>Co-operative Societies which stood governed by the provisions<\/p>\n<p>of Ext.P1 Government Order.                  In terms thereof, the<\/p>\n<p>Government      came      forward     to    provide     assistance     and<\/p>\n<p>essentially  salvage      four    projects      under     four    different<\/p>\n<p>Co-operative Societies which were for the purpose of Girijan<\/p>\n<p>Communities. The projects were fundamentally implemented<\/p>\n<p>by the Planning and Economic Affairs Department under the<\/p>\n<p>Western Ghats Development Programme during the V &amp; VI Five<\/p>\n<p>Year Plan periods for the economic rehabilitation of tribals by<\/p>\n<p>forming co-operative societies under Government auspices.<\/p>\n<p>Thereafter the administrative control of those societies were<\/p>\n<p>transferred   from     Economic       Affairs    Department        to   the<\/p>\n<p>Agricultural Department to ensure technical supervision.<\/p>\n<p>Ultimately, with the passage of time, the requirement of those<\/p>\n<p>W.A.No. 2688 OF 2009<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>societies to be manned by personnel appointed on different<\/p>\n<p>terms, became unnecessary.          Since the societies fell to be<\/p>\n<p>non-functional, the purpose of the Societies had essentially<\/p>\n<p>worked out.\n<\/p>\n<p>      2. Petitioners made the technical plea that they have not<\/p>\n<p>been terminated from service, as understood in law, nor<\/p>\n<p>retrenched and therefore they are entitled to pay for the period<\/p>\n<p>during which they continued on the rolls and were permitted to<\/p>\n<p>sign the attendance register.         The admitted case of the<\/p>\n<p>petitioners is that though they signed the attendance register,<\/p>\n<p>they had not done any work.           It may be true that formal<\/p>\n<p>termination was done only at a later point of time. But, taking<\/p>\n<p>the overall situation of the societies into consideration and all the<\/p>\n<p>relevant facts, the learned Single Judge has rightly exercised the<\/p>\n<p>discretion by rejecting the petitioners&#8217; request and has<\/p>\n<p>categorically stated in paragraph 6 of the impugned judgment<\/p>\n<p>that no issue relating to the reinstatement arises and the<\/p>\n<p>petitioners&#8217; claim for salary for the period during which they were<\/p>\n<p>alleged to be kept out of employment could be considered only<\/p>\n<p>W.A.No. 2688 OF 2009<br \/>\n<span class=\"hidden_text\">                                 -:3:-<\/span><\/p>\n<p>on the principle of &#8220;no work, no pay&#8221;.\n<\/p>\n<p>      3.  On the facts, the learned Judge held that when the<\/p>\n<p>petitioners had not admittedly worked for the period in question,<\/p>\n<p>there is absolutely no reason to exercise the jurisdiction under<\/p>\n<p>Article 226 of the Constitution and to direct payment of salary for<\/p>\n<p>that period, merely for the default on the part of the Government<\/p>\n<p>or the Society in issuing a formal order dispensing with their<\/p>\n<p>services, also like that of the labourers. The said decision of the<\/p>\n<p>learned Single Judge is rendered in discretionary jurisdiction;<\/p>\n<p>stating clear reasons, which according to us, require no<\/p>\n<p>interference in appeal.\n<\/p>\n<p>      For the aforesaid reasons, the Writ Appeal fails and the<\/p>\n<p>same is accordingly dismissed.\n<\/p>\n<\/p>\n<p>                                        S.R.
