No.21089 of 2010\n                  PINTU KUMAR VISHWAKARMA SON OF ROHAN\n                  VISHWAKARMA, RESIDENT OF VILLAGE KARMAHI, P.S.\n                  DAUDNAGAR, DISTRICT AURANGABAD (BIHAR) -\n                  PETITIONER.\n                                        Versus\n                         THE STATE OF BIHAR--OPP. PARTY.\n                                          -----------\n<\/pre>\n<p>5\/   25-08-2010            Both these cases arise out of the same P.S.<\/p>\n<p>                  case and as such they have been heard together and<\/p>\n<p>                  are being disposed of by this common order.<\/p>\n<p>                           The petitioners in both cases have been<\/p>\n<p>                  arrayed in the category of accused in a criminal<\/p>\n<p>                  prosecution registered under section 392 of the Indian<\/p>\n<p>                  Penal Code.\n<\/p>\n<p>                           It is submitted that the petitioners are not<\/p>\n<p>                  named in the F.I.R. Though the petitioners are in<\/p>\n<p>                  judicial custody since last week of January, 2010 but<\/p>\n<p>                  till date they have not been put on T.I.Parade. It is<\/p>\n<p>                  contended     that   the   looted   money   has   not   been<\/p>\n<p>                  recovered either from the house or from the possession<\/p>\n<p>                  of the petitioners. Only material against petitioners is<\/p>\n<p>                  that one allegedly stolen SIM Card was found used in<\/p>\n<p>                  mobile set of the petitioner- Jai Prakash Vishwakarma.<\/p>\n<p>                  From the electronic shop of petitioner Pintu Kumar<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>Vishwakarma allegedly looted mobile set was recovered,<\/p>\n<p>but the seized articles have not been put on T.I.Parade.<\/p>\n<p>It has been specifically stated by the petitioners that<\/p>\n<p>they are men of fair antecedent and there is no criminal<\/p>\n<p>history against them and save and except the present<\/p>\n<p>case they are not accused in any other criminal case.<\/p>\n<p>The petitioners were arrested in the last week of<\/p>\n<p>January, 2010.\n<\/p>\n<p>          Be   that    as   it   may,    in    the   facts   and<\/p>\n<p>circumstance the above named petitioners are directed<\/p>\n<p>to be enlarged on bail on furnishing bail bonds of Rs.<\/p>\n<p>10,000\/- each with two sureties of the like amount each<\/p>\n<p>to the satisfaction of SDJM, Daudnagar, District<\/p>\n<p>Aurangabad in Obra P.S. Case No. 182 of 2009 subject<\/p>\n<p>to the conditions that :\n<\/p>\n<p> (A)             one of the bailors must be government<\/p>\n<p>                 servant or close family members of the<\/p>\n<p>                 petitioners, who will file an affidavit in<\/p>\n<p>                 the    court    below        showing   his\/her<\/p>\n<p>                 relationship with the petitioners,<\/p>\n<p> (B)             if the petitioners are found involved in<\/p>\n<p>                 same and similar nature of cases in<\/p>\n<p>                 future,     then   in        that   case    the<\/p>\n<p>                 informant\/ prosecution shall be at<\/p>\n<p>                 liberty to file a petition for cancellation<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>                 of the bail of the petitioners, and if<\/p>\n<p>                 such a petition is filed, the court below<\/p>\n<p>                 would be obliged to dispose of the same<\/p>\n<p>                 in accordance with law after giving<\/p>\n<p>                 opportunity of hearing to all concerned<\/p>\n<p>                 and<\/p>\n<p>           (C)   the     petitioners   shall   make    regular<\/p>\n<p>                 pairvi in the court below in the present<\/p>\n<p>                 case either by appearing themselves in<\/p>\n<p>                 person or through representation by<\/p>\n<p>                 their lawyer on each and every dates,<\/p>\n<p>                 and     if   on   two   consecutive    dates<\/p>\n<p>                 petitioners fail to make pairvi, then the<\/p>\n<p>                 court below shall be at liberty to cancel<\/p>\n<p>                 the bail bonds of the petitioners.<\/p>\n<p>                       ( Birendra Prasad Verma, J.)<br \/>\nBTiwary\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Jaiprakash Vishwakarma vs State Of Bihar on 25 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
