No.485\/1989<br \/>\ndated 02.05.1998, whereby, the said claim petition was partly<br \/>\nallowed. By way of this appeal, the appellant has prayed for<br \/>\nenhancement of the amount of compensation.\n<\/p>\n<p>2.<br \/>\n\tThe facts in brief are that on 23.05.1989 while the appellant was<br \/>\nproceeding towards his garage by foot situated on the high-way road,<br \/>\nan auto-rickshaw bearing registration no. GRO-184, driven by<br \/>\nrespondent no.1 herein, dashed him from the behind. As a result of<br \/>\nthe said accident, the appellant sustained bodily injuries and he was<br \/>\ntaken to the Hospital for necessary treatment. Thereafter, the<br \/>\nappellant filed the claim petition before the Tribunal claiming<br \/>\ncompensation of Rs.2,00,000\/-. However, the same came to be partly<br \/>\nallowed by way of the impugned award. Hence, this appeal for<br \/>\nenhancement of the amount of compensation.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The main submission of learned counsel for the appellant<br \/>\nis that the Tribunal has not properly assessed the income of the<br \/>\nappellant while calculating the amount of compensation. However, I do<br \/>\nnot find much substance in the submission made by the learned counsel<br \/>\nsince the Certificate (Exhibit-56) produced in support of the income<br \/>\nof the appellant is of a subsequent date. Therefore, the said<br \/>\ndocument cannot be taken into consideration. The Tribunal has awarded<br \/>\nthe amount by assessing the monthly income of the appellant at<br \/>\nRs.900\/-. In the claim petition itself, the appellant has stated that<br \/>\nhis monthly income was Rs.900\/-.\n<\/p>\n<p>4.\tLooking<br \/>\nto the facts of the case and the evidence produced on record, the<br \/>\ncompensation awarded by the Tribunal is just, appropriate and legal.<br \/>\nThe appellant has not made out any case for enhancing the amount of<br \/>\ncompensation. I am in complete agreement with the reasonings given by<br \/>\nand the findings arrived at by the Tribunal in the impugned award and<br \/>\nhence, find no reasons to interfere with the same.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the appeal is dismissed.
