Justice K.HEMA\n\n Dated :03\/02\/2009\n\n O R D E R\n                           K.HEMA, J.\n\n               -----------------------------------------\n                        B.A.No. 7489 of 2008\n               -----------------------------------------\n\n            Dated this the 3rd February, 2009\n\n                            O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.<\/p>\n<p>      2. The alleged offences are under Sections 457 and 380<\/p>\n<p>read with 34 of the Indian Penal Code. According to<\/p>\n<p>prosecution, accused 1, 3 and 4 committed theft of rubber<\/p>\n<p>sheets worth Rs.55,000\/- and second accused was driving a<\/p>\n<p>pick up van, into which those were loaded and accused 1 to 4<\/p>\n<p>committed theft and other offences with a common intention.<\/p>\n<p>The incident occurred on 22.10.2008.<\/p>\n<p>      3. Learned counsel for petitioners submitted that<\/p>\n<p>petitioners are accused 3 and 4 and they have not committed<\/p>\n<p>any offence. They are head load workers and they have only<\/p>\n<p>loaded the rubber sheets under instructions and they have not<\/p>\n<p>committed any theft, it is submitted. They may be granted<\/p>\n<p>anticipatory bail, it is submitted.\n<\/p>\n<p>      4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that as per the materials in the case diary,<\/p>\n<p>petitioners have actually committed the theft and they are not<\/p>\n<p><span class=\"hidden_text\">  BA.7489\/08                      2<\/span><\/p>\n<p>mere head load workers as alleged. It is not a fit case to grant<\/p>\n<p>anticipatory bail, it is submitted.\n<\/p>\n<p>     5. On hearing both sides, considering the serious nature<\/p>\n<p>of the allegations made, I am satisfied that it is not a fit case to<\/p>\n<p>grant anticipatory bail. The crime is registered as early as on<\/p>\n<p>22.10.2008 and petitioners are bound to co-operate with the<\/p>\n<p>investigation.\n<\/p>\n<p>               Petitioner shall surrender before the<\/p>\n<p>          investigating officer forthwith and co-operate<\/p>\n<p>          with the investigation.
