Considering his request,<br \/>\n\tpermission is granted to join Shri Ramanbhai Dahyabhai Patel as<br \/>\n\tparty respondent NO.5 to present special civil application. Learned<br \/>\n\tAdvocate Mr. Dipak V. Patel submits that he will appear on behalf of<br \/>\n\tnewly added respondent No.5. Accordingly, cause title is to be<br \/>\n\tamended by petitioner.\n<\/p>\n<p>In<br \/>\n\tthis petition, petitioner has made prayers in paragraph 21 (A) to<br \/>\n\t(D), which are quoted as under:\n<\/p>\n<p> (A)\tYour<br \/>\n\tLordships may kindly be pleased to issue a writ of Mandamus and or<br \/>\n\tany other appropriate writ, direction and order to quash and set<br \/>\n\taside the communication dated 12.4.2010 issued by respondent NO.1 at<br \/>\n\tAnnexure K to this petition.\n<\/p>\n<p>(B)\tYour<br \/>\n\tLordships may kindly be pleased to issue a writ of Mandamus and or<br \/>\n\tany other appropriate writ direction and order  to direct the<br \/>\n\trespondents no.1 and 2 to hold the election for the year 2010 of the<br \/>\n\trepresentative members, executive members and office bearer, as per<br \/>\n\tthe constitution of the union and the provisions of Trade Union Act,<br \/>\n\t1926.\n<\/p>\n<p>(C)<br \/>\n\tYour Lordships may kindly be pleased to quash and set aside the<br \/>\n\trequisition notice dated 9.4.2010 and the communication dated<br \/>\n\t13.4.2010 at Annexure H and O respectively to this petition by<br \/>\n\tholding and declaring that the same is illegal, unjust, unfair and<br \/>\n\tit has been issued on the basis of the so called resolution passed<br \/>\n\tin the meeting which was held and conducted without following due<br \/>\n\tprocedure of law by the respondent Nos. 3 and 4 in presence of the<br \/>\n\trepresentative of the respondent NO.1.\n<\/p>\n<p>(D)\tPending<br \/>\n\thearing and final disposal of this petition, Your Lordships may be<br \/>\n\tpleased to direct the respondent no.2 union to hold the meeting of<br \/>\n\tthe representative members after following due procedure, for<br \/>\n\tpassing the necessary resolution.\n<\/p>\n<p>Considering<br \/>\n\taforesaid prayers made by petitioner, according to my opinion,<br \/>\n\tpetitioner is having alternative, effective and statutory remedy to<br \/>\n\tapproach Registrar of Trade Unions Act, 1926 under section 14-A read<br \/>\n\twith sub section (1), (2),(3) and (4), therefore, present petition<br \/>\n\tis not entertained by this Court and only on that ground that<br \/>\n\tpetitioner is having alternative effective and statutory remedy<br \/>\n\tunder section 14-A of Trade Unions Act, 1926, present petition is<br \/>\n\tdisposed of by this Court without expressing any opinion on merits<br \/>\n\twith a liberty to petitioner to approach appropriate authority under<br \/>\n\tprovisions of section 14-A sub section (1) to (4) of Trade Unions<br \/>\n\tAct, 1926.\n<\/p>\n<p>As<br \/>\n\tand when petitioner approaches Registrar of Trade Unions Act, 1926,<br \/>\n\tlet Registrar may pass appropriate orders and, thereafter, it is<br \/>\n\topen for petitioner to approach Industrial Court for interim relief<br \/>\n\tas well as provided under section 14-A of Trade Unions Act, 1926. As<br \/>\n\tand when such interim relief application is made by petitioner, let<br \/>\n\tIndustrial Court may examine it in accordance with law after giving<br \/>\n\treasonable opportunity of hearing to all respective parties and<br \/>\n\tdecide it preferably within period of one month from date of<br \/>\n\treceiving reply of such application from respective other parties.\n<\/p>\n<p>In<br \/>\n\tview of order passed by this court in special civil application<br \/>\n\tpermitting petitioner to join Shri Ramanbhai Dahyabhai Patel as<br \/>\n\tparty respondent NO.5 to special civil application, present Civil<br \/>\n\tApplication filed by applicant Shri Ramanbhai Dahyabhai Patel is<br \/>\n\talso required to be disposed of.
