The<br \/>\nTribunal has imposed penalty of stoppage of one increment without<br \/>\nfuture effect upon the respondent and directed to the petitioner to<br \/>\npay 50% differential amount.\n<\/p>\n<p>2.0\tThe<br \/>\nrespondent was serving with the petitioner Corporation as Conductor.<br \/>\nOn surprise checking of checking squad of petitioner-Corporation, it<br \/>\nwas found that the respondent had not issued ticket  to one passenger<br \/>\nthough fare was collected from him and also instigated the passengers<br \/>\nand not co-operated with the officers while checking his bus. In view<br \/>\nof such misconduct, the respondent was issued charge-sheet  as the<br \/>\nrespondent was found defaulter, misappropriation of money,<br \/>\nmisbehaviour and negligent in discharging his duty. After holding<br \/>\ndepartmental inquiry, a punishment of stoppage of  two increments<br \/>\nwith future effect was imposed upon him. The respondent preferred<br \/>\nfirst appeal which came to be rejected. The respondent therefore<br \/>\nraised a dispute which was numbered as  Reference (IT) No.19 of 1998<br \/>\nbefore the  Industrial Tribunal, Rajkot. The Tribunal after<br \/>\nadjudicating the matter, passed the award as stated hereinabove.<br \/>\nHence, this petition.\n<\/p>\n<p>3.0\tLearned<br \/>\nadvocate for the respondent has submitted that the Tribunal has<br \/>\ncommitted error inasmuch there are 26 defaults committed by the<br \/>\nrespondent and keeping in mind the seriousness of the misconduct on<br \/>\nthe part of the respondent, the Tribunal while exercising power under<br \/>\nSection 11(A) of the Industrial Disputes Act, 1947 the penalty should<br \/>\nbe proportionate to the misconduct committed by the respondent.\n<\/p>\n<p>4.0\tLearned<br \/>\nadvocate for the respondent has supported the judgment and award of<br \/>\nthe Tribunal.\n<\/p>\n<p>5.0\tHeard<br \/>\nthe learned Advocates for the respective parties and perused the<br \/>\nrelevant record. As a result of this exercise, I am of the view that<br \/>\nthe Tribunal has committed an error in not considering the 26 past<br \/>\ndefaults on the part of the respondent. In view of such past<br \/>\ndefaults, the punishment imposed by the Tribunal is too lenient and<br \/>\nnot in consonance with the gravity of the misconduct. Having<br \/>\nconsidered the matter in depth, I am of the view interest of justice<br \/>\nwould be met by restoring the order of punishment of imposition of<br \/>\npenalty of stoppage of  two increments with future effect passed by<br \/>\nthe competent authority of the petitioner-Corporation.\n<\/p>\n<p>6.0\tAccordingly<br \/>\na punishment of stoppage of two increments with future effect shall<br \/>\nbe imposed upon the respondent. The judgement and award of the Labour<br \/>\nCourt is modified accordingly. Rule is made absolute to the aforesaid<br \/>\nextent with no order as to costs.
