PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nMR ANVESH V VYAS for Respondent(s) :\n2, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr.L.R.Poojari, learned APP and Mr.Anvesh Vyas, learned Advocate<br \/>\nwaive service of rule on behalf of respondent no.1 and 2<br \/>\nrespectively.\n<\/p>\n<p>2.\t\tPresent<br \/>\napplication is filed by the applicants to quash the complaint dated<br \/>\n14.09.2010 being C.R.No.I-197 of 2010 registered with &#8220;A&#8221;<br \/>\nDivision Police Station, Junagadh City for the offence punishable<br \/>\nunder section 379 of Indian Penal Code.\n<\/p>\n<p>3.\t\tIt<br \/>\nis the case of the applicants that complaint was filed by respondent<br \/>\nno.2 &#8211; original complainant. In the complaint it is stated that<br \/>\nthe complainant had parked his taxi in front of his house and went to<br \/>\nAmerli and when he returned back he did not found his taxi. It is<br \/>\nalso stated in the complaint that he has tried to search the taxi but<br \/>\ncould not trace out.  Therefore, complainant filed complaint against<br \/>\npresent applicants.\n<\/p>\n<p>4.\t\tIt<br \/>\nis submitted by Mr.Parikh, learned Advocate for the applicants that<br \/>\napplicants are accused in Criminal Case no.3593 of 2010 which is<br \/>\npending before the learned JMFC Court, Junagadh. It is submitted that<br \/>\noriginal complainant had taken loan from the Bank where present<br \/>\napplicants are working. One of the applicant is Branch Manager and<br \/>\nothers are employees of Bank and as per guidelines of Reserve Bank of<br \/>\nIndia they initiated steps to recover loan amount from respondent<br \/>\nno.2 &#8211; original complainant as he failed to make payment of<br \/>\nloan amount.  The applicants followed guidelines issued by Reserve<br \/>\nBank of India and issued notice to original complainant as well as<br \/>\ninformed police before taking custody of the vehicle and thereafter,<br \/>\nthey took custody of said vehicle.  Mr.Parikh, learned Advocate for<br \/>\nthe applicants has drawn attention of this Court to relevant<br \/>\ndocuments which prima facie shows that after following guidelines of<br \/>\nReserve Bank of India and after following due procedure of law,<br \/>\napplicants took custody of vehicle and no offence is committed by the<br \/>\npresent applicants.  Mr.Parikh, learned Advocate has relied upon<br \/>\nfollowing decisions in support of his submissions and to allow the<br \/>\npresent petition :-\n<\/p>\n<p>1.\tCharanjit<br \/>\nSingh Chadha and Ors. v\/s. Sudhir Mehra [2001 SCC (Cri.) 1557] of<br \/>\nHon&#8217;ble Supreme Court of India.\n<\/p>\n<p>2.\tCriminal<br \/>\nMisc. Application No.2708 of 2007 dated 31.07.2007 of Hon&#8217;ble High<br \/>\nCourt of Gujarat<\/p>\n<p>5.\t\tPetition<br \/>\nis opposed by Mr.Vyas, learned Advocate for the original complainant.<br \/>\nIt is submitted that charge sheet is filed and prima facie offence is<br \/>\nmade out and this petition is filed at belated stage and is required<br \/>\nto be dismissed.\n<\/p>\n<p>6.\t\tLearned<br \/>\nAPP for respondent no.1 &#8211; State has requested to pass<br \/>\nappropriate order.\n<\/p>\n<p>7.\t\tTaking<br \/>\ninto consideration allegations made in the complaint, it is very<br \/>\ndifficult to believe that theft is committed by the present<br \/>\napplicants. It prima facie seems that against recovery of loan<br \/>\namount, complainant has filed complaint as counter blast against<br \/>\npresent applicants.  It is not in dispute that original complainant<br \/>\nhad taken loan amount from the Bank of applicants. However, he failed<br \/>\nto make payment of loan amount and therefore, notice was issued as<br \/>\nper guidelines of Reserve Bank of India, therefore, it cannot be said<br \/>\nthat any offence is made out against applicants for the offence<br \/>\npunishable under section 379 of Indian Penal Code as they took the<br \/>\npossession of vehicle after following due procedure of law.  It is<br \/>\nalso pertinent to note that so far as present applicants are<br \/>\nconcerned, they are not going to gain any monetary benefits but in<br \/>\nthe interest of financial company (Bank) they  issued notice to<br \/>\noriginal complainant.\n<\/p>\n<p>8.\t\tIn<br \/>\nview of above and considering the decisions referred to above,<br \/>\npresent petition succeed.
