In<br \/>\ncompliance of the same, fresh Notice was issued on the appellant by<br \/>\nthis court.  Referring the endorsement made by Rajesh Ramlal Nayak,<br \/>\nson of the present appellant, it appears that the appellant Ramlal<br \/>\nRanchhodlal Nayak has passed away in the year 1996 and accordingly<br \/>\nprocess server has also made endorsement below the said fresh Notice<br \/>\ndated 17.6.2011.  It appears that thereafter the legal heirs of the<br \/>\ndeceased Ramlal Ranchhodlal Nayak has not made any efforts to join<br \/>\nthem as legal heirs\/legal representatives of the deceased Ramlal<br \/>\nRanchhodlal Nayak.
