By interim order it is observed that   this<br \/>\nCourt at  direction No. 10(4) had observed to exclude the members who<br \/>\nhave already withdrawn their  share capital  from their concerned<br \/>\nsavings account in the election to be held.  Therefore,  the<br \/>\nrespondent Nos. 1 and 2  shall strictly comply with the said<br \/>\ndirection for holding of the election.  D.S. is permitted today.&#8221;\n<\/p>\n<p>Pursuant<br \/>\n\tto the aforesaid direction, Mr.K.R.Rathod, respondent no.1 and<br \/>\n\tMr.Dataniya, respondent no. 2 are personally present.  Mr.B.S.Patel<br \/>\n\tappears for the original petitioners.\n<\/p>\n<p>It<br \/>\n\thas been explained to respondents no. 1 and 2 that after the amount<br \/>\n\tof share capital is credited in the Bank account of the concerned<br \/>\n\tmember, if any withdrawal has been made by reduction of the said<br \/>\n\tbalance of the return of the share capital, such persons will be<br \/>\n\trequired to be excluded from the voters list, but if the credit of<br \/>\n\tthe share capital is not withdrawn or balance is consistently<br \/>\n\tmaintained by keeping the said amount intact, their names would be<br \/>\n\trequired to be continued in the voters list.\n<\/p>\n<p>The<br \/>\n\trespondents no. 1 and 2 undertake to comply with the aforesaid<br \/>\n\tdirection, if required, by suitably modifying the voters list.<br \/>\n\tHence, respondents no.1 and 2 are directed to act accordingly.\n<\/p>\n<p>Application<br \/>\n\tdisposed of accordingly.
