03.   20.07.2010            Heard learned counsel for the petitioner and the<\/p>\n
                   State.\n<\/p>\n
                            The basic grievance of the petitioner is against<\/p>\n
                   the order dated 17.01.2006 issued by the Accountant<\/p>\n
                   General as contained in Annexure- 10 with regard to the<\/p>\n
                   deduction of 25 percent of the pension, in view of the<\/p>\n
                   order passed by the Director, Secondary Education,<\/p>\n
                   Patna as per letter no. 1898 dated 28th of June 2005.<\/p>\n
                   The aforesaid letter of the Director, Secondary Education<\/p>\n
                   is not under challenge. However, on perusal of the said<\/p>\n
                   order, as contained in Annexure- 10 series at page 46, it<\/p>\n
                   would appear     that by   the aforesaid order    after a
\n                     2<\/span><\/p>\n
department enquiry the petitioner was imposed with the<\/p>\n
aforesaid punishment of deduction of 25 percent of the<\/p>\n
pension.\n<\/p>\n
           In this view of the matter letter issued by the<\/p>\n
Accountant General as contained in annexure- 10 does<\/p>\n
not suffer from any illegality     and the same has been<\/p>\n
issued pursuant to the order passed by the Director,<\/p>\n
Secondary Education in a departmental enquiry for the<\/p>\n
charge proved against the petitioner.<\/p>\n
           Learned counsel for the petitioner submits that<\/p>\n
he has not been paid his gratuity, however, there is no<\/p>\n
such prayer nor any averments made in the writ petition.<\/p>\n
More so, petitioner earlier filed a writ petition      with<\/p>\n
respect to the payment of retiral dues especially with<\/p>\n
regard to leave encashment. The writ petition was<\/p>\n
disposed of by order dated 09.10.2001 in C.W.J.C. No.<\/p>\n
12708 of 2001 as contained in Annexure- 5.<\/p>\n
           From perusal of the counter affidavit as also the<\/p>\n
copy of the bank cheque as contained in Annexure- C<\/p>\n
the amount of leave encashment        has been paid     and<\/p>\n
received by the         petitioner who made endorsement on<\/p>\n
the back of the said cheque. Even though there is no<\/p>\n
specific    averment     with regard to the non-payment of<\/p>\n
gratuity, however, learned counsel for the petitioner<\/p>\n
submits that petitioner has not been paid his gratuity.
\n                               3<\/span><\/p>\n
           In absence of any such averment, this court is not in a<\/p>\n
           position to issue any direction with regard to the payment<\/p>\n
           of gratuity.\n<\/p>\n
                    Counsel for the State submits that prayer of the<\/p>\n
           petitioner     challenging the claim for payment of 25<\/p>\n
           percent of the pension which has been deducted is not<\/p>\n
           admissible to him for the reason that         the aforesaid<\/p>\n
           deduction of 25 percent of the pension from his pension<\/p>\n
           has been passed as a measure of punishment after<\/p>\n
           holding a departmental enquiry. The charges against the<\/p>\n
           petitioner have been found proved and the said order of<\/p>\n
           punishment still subsisted.\n<\/p>\n
                    Considering the submission of the parties I do<\/p>\n
           not find any merit in this writ application and the same is<\/p>\n
           accordingly, dismissed.\n<\/p>\n<\/p>\n
