On<br \/>\n18th January 2010 this Court passed the following order in<br \/>\nSCA No. 11967 of 2006 :\n<\/p>\n<p>&#8221; Mr<br \/>\nDipen Shah learned counsel for the petitioner  seeks permission to<br \/>\nwithdraw this petition  with a liberty to prefer an appeal.<br \/>\nPermission as prayed for is granted. The petition  stands disposed of<br \/>\nas withdrawn. The interim relief  granted vide order dated 28.6.2006<br \/>\nwill continue  for a period  of two weeks  from today. It is however,<br \/>\n observed that the petitioner will prefer  an appeal within  a period<br \/>\nof two weeks from today. &#8221;\n<\/p>\n<p>\tHaving<br \/>\nheard the learned advocates and perusal of the record it apparent<br \/>\nthat there is total negligence on the part of the applicant  and no<br \/>\nsufficient cause is shown to condone the delay. Further parallel<br \/>\nproceedings were initiated by the applicant  which is nothing  but an<br \/>\nabuse of process of law. The Court should not take a lenient  view in<br \/>\nfavour of a litigant  who is taking chance by preferring several<br \/>\nlitigations.\n<\/p>\n<p>\tLooking<br \/>\nto the overall  facts and circumstances of the case  am of the view<br \/>\nthat no case is made out to condone the delay.
