            The petitioner is the registered owner and in<\/p>\n
possession of a mini tipper lorry bearing registration No.KL-39A-<\/p>\n
849. Ext.P1 is the copy of the relevant page of the registration<\/p>\n
certificate produced in support of the above plea.<\/p>\n
       2.   It is averred in the writ petition that the vehicle was<\/p>\n
used for transport of building materials including bricks, cement,<\/p>\n
sand, etc. on hire. On 19-12-2009 at about 8.15 a.m. while the<\/p>\n
said vehicle was transporting ordinary sand from K.S.Mangalam to<\/p>\n
Ernakulam via Thripunithura, it was intercepted by the Sub<\/p>\n
Inspector of Police, the second respondent herein. According to<\/p>\n
the petitioner, the driver of the vehicle produced the statutory pass<\/p>\n
which was kept in the cabin(Ext.P2). It is alleged that the second<\/p>\n
respondent seized the vehicle and reported the seizure to the first<\/p>\n
respondent for initiation of proceedings under the provisions of<\/p>\n
Kerala Protection of River Bank and Removal of Sand(Regulation)<\/p>\n
Act, 2001. After awaiting suitable action for a number of days, the<\/p>\n

petitioner approached the first respondent, District Collector, by<\/p>\n
Ext.P3 request for release of the vehicle by way of interim custody<\/p>\n
pending further action. The same was disposed of by Ext.P4.<\/p>\n
Thereby, the vehicle has been ordered to be released on fulfilling<\/p>\n
certain conditions.\n<\/p>\n
      3.    The District Collector while passing the order relied<\/p>\n
upon the judgment of the Division Bench in W.A.No.2578 of 2009<\/p>\n
for imposing various conditions. After getting the details of the<\/p>\n
value of the vehicle from the Regional Transport Officer, the value<\/p>\n
of the vehicle has been shown in Ext.P4 as Rs.5,50,000\/-. The<\/p>\n
District Collector, hence, directed the petitioner to remit a sum of<\/p>\n
Rs.2,75,000\/- in the River Management Fund and to submit a<\/p>\n
bond for the balance amount.\n<\/p>\n
      4.    The grievance of the petitioner is that the direction to<\/p>\n
remit the amount of Rs.2,75,000\/- is arbitrary.<\/p>\n
      5.    Heard the learned counsel for the petitioner and the<\/p>\n
learned Government Pleader. The learned Government Pleader<\/p>\n
brought to my notice that in the light of the directions issued by the<\/p>\n
Division Bench in W.A.No.2578 of 2009, there is nothing wrong in<\/p>\n

the District Collector prescribing the said condition for releasing<\/p>\n
the vehicle.    For convenience, I extract paragraph 7 of the<\/p>\n
judgment in W.A.No.2578 of 2009 as follows:-<\/p>\n
                  ” 7. Having regard to the fact that large<\/p>\n
            number of cases involving illegal transportation<\/p>\n
            of sand in violation of the provisions contained<\/p>\n
            in  Kerala    Protection   of  River   Banks   &<\/p>\n
            Regulation of Removal of Sand Act, 2001, we are<\/p>\n
            of the view that following guidelines\/directions<\/p>\n
            have to be issued with regard to the release of<\/p>\n
            vehicles that may be involved in such cases.<\/p>\n<\/blockquote>\n
                  (i)    The vehicle shall be released to the<\/p>\n
            registered owner on his depositing half of the<\/p>\n
            total value of the vehicle as may be assessed by<\/p>\n
            the Assistant Executive Engineer(Mechanical),<\/p>\n
            PWD as provided under Rule 4 of the Kerala<\/p>\n
            Abkari(Disposal of Confiscated Articles) Rules,<\/p>\n
            1996 or the Assistant Motor Vehicles Inspector.<\/p><\/blockquote>\n
                  (ii)   The registered owner shall execute a<\/p>\n
            bond furnishing security for the balance amount<\/p>\n
            to the satisfaction of the District Collector<\/p>\n
            concerned.     He shall further undertake to<\/p>\n
            produce the vehicle as and when directed and<\/p>\n
            also not to transfer\/alienate the vehicle pending<\/p>\n
            the proceedings. It shall also be undertaken by<\/p>\n

            the registered owner that he will not cause any<\/p>\n
            damage to the vehicle so as to reduce its value<\/p>\n
            and utility.\n<\/p>\n
                  (iii) If the vehicle gets involved in a<\/p>\n
            similar offence after such release, it shall be<\/p>\n
            liable to immediate seizure, in which event it<\/p>\n
            shall not be released until finalisation of the<\/p>\n
            proceedings.”\n<\/p>\n
      In the light of the above direction issued by the Division<\/p>\n
Bench, I do not find any illegality or irregularity in Ext.P4 order<\/p>\n
passed by the District Collector. Therefore, the writ petition is<\/p>\n
dismissed. This judgment will not stand in the way of the District<\/p>\n
Collector passing final orders in respect of the proceedings<\/p>\n
pending before him, within two months, after hearing the petitioner<\/p>\n
and after assessing the various materials produced by the<\/p>\n
petitioner. No costs.\n<\/p>\n<\/p>\n
