SHRI VARKALA RADHAKRISHNAN\u00a0 <\/a>: The Kerala Legislative Assembly early in 1957, when late Shri E.M.S. Namboothiripad was the Chief Minister, unanimously adopted a Resolution towards the establishment of a Bench of the Kerala High Court at Trivandrum, the State Capital. \u2026 (Interruptions)\n<\/p>\n
MR. SPEAKER<\/a>: This is not fair.\u00a0 What is this?\u00a0 Can you rise at any time and say something?\u00a0 \u0928\u094b\u091f\u093f\u0938 \u0928\u0939\u0940\u0902, \u0915\u0941\u091b \u0928\u0939\u0940\u0902, \u0915\u094d\u092f\u093e \u092c\u093e\u0924 \u0939\u0948?\n<\/p>\n
\u00a0  <\/p>\n
SHRI VARKALA RADHAKRISHNAN <\/a>: Subsequently, when the present Defence Minister Shri A.K. Antony was the Chief Minister, the Kerala Legislative Assembly again unanimously adopted a Resolution towards the establishment of a Bench of the Kerala High Court at Trivandrum.\u00a0 The present Government in their turn have provided sufficient funds for the establishment of a Bench in the current year\u2019s Budget. There is also a Private Members\u2019 Bill towards the establishment of this Bench before the House but still the Government is not taking action.\u00a0Even the Chief Justice of India\u2026 (Interruptions)\n<\/p>\n
MR. SPEAKER<\/a>: Judiciary has to take action first.\u00a0 Learned Judges have to decide.\n<\/p>\n
SHRI VARKALA RADHAKRISHNAN <\/a>: The Chief Justice of India has claimed that it is for the Central Government to make a precedent to issue Notification under the provisions of the States Reorganisation Act.\n<\/p>\n
MR. SPEAKER<\/a>: Government must agree.\u00a0 Judges must agree.\n<\/p>\n
SHRI VARKALA RADHAKRISHNAN\u00a0 <\/a>: There is one option before the Government.\u00a0 Either the Government must accept the Private Members\u2019 Resolution or they must make a declaration before the House that they will issue Notification. For three months the hunger strike by lawyers is going on in Trivandrum and the Government is quite inactive.\u00a0 The State Government has already recommended it. \u2026 (Interruptions)\u00a0 I would also be forced to resort to action.\u00a0 Before this House I will have to take action and request the Government to act in this matter. \u2026 (Interruptions)\n<\/p>\n
MR. SPEAKER<\/a>: All hon. Members from Kerala are associating with it.\n<\/p>\n
SHRI VARKALA RADHAKRISHNAN <\/a>: I would request the Government of India and the President of India to issue a Notification towards the establishment of the Bench. \u2026 (Interruptions)\n<\/p>\n

SHRI VARKALA RADHAKRISHNAN <\/a>: There is no such provision anywhere. \u2026 (Interruptions) Judiciary has taken a stand, whenever the word \u2018consult\u2019 is used, they have interpreted it as \u2018consent\u2019. \u2026 (Interruptions) Whenever the word \u2018consult\u2019 is used, it reveals \u2018consent\u2019.\u00a0So, you must be doubly cautious.\u00a0Whenever you pass any statute, do not use the word \u2018consult\u2019 hereafter because that will be taken as consent and we would not be able to implement the Act itself.\u00a0 Such is the situation in the country.\u00a0 In the Chamber\u2019s Dictionary or any other dictionary used in any part of the world where English is spoken you find words \u2018consult\u2019 and \u2018consent\u2019.[R16]\u00a0  <\/p>\n
