THE DEPUTY SECRETARY &amp; 2 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMS\nKRISHNA U MISHRA for\nPetitioner(s) : 1, \nMR KP RAVAL, AGP for Respondent(s) : 3, \nRULE\nSERVED BY DS for Respondent(s) : 1 -\n2. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 07\/10\/2011 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThis<br \/>\npetition is directed against the order of detention dated 08\/07\/2011<br \/>\npassed by respondent No.2, in exercise of powers conferred under<br \/>\nSection 3(1)\/3(2) of the Gujarat Prevention of Anti Social Activities<br \/>\nAct, 1985 (in short &#8220;the Act&#8221;) by detaining the detenue<br \/>\nas a &#8220;bootlegger&#8221; as defined under Section 2(b) of the<br \/>\nAct.\n<\/p>\n<p>2.\tLearned<br \/>\nAdvocate for the detenue submits that registration of FIR&#8217;s itself<br \/>\ncannot lead to disturbance of even tempo of public life and therefore<br \/>\nthe public order.  He further submits that, except FIR&#8217;s registered<br \/>\nunder the Bombay Prohibition Act, there was no other material before<br \/>\nthe detaining authority whereby it could be inferred reasonably that<br \/>\nthe detenue is a &#8216;bootlegger&#8217; within the meaning of Section 2(b) of<br \/>\nthe Act and required to be detained as the detenue&#8217;s activities are<br \/>\nprejudicial to the maintenance of public health and public order.  In<br \/>\nsupport of the above submission, learned Counsel for the detenue has<br \/>\nplaced reliance on judgment of the Apex Court in the case of <a href=\"\/doc\/1169973\/\">Piyush<br \/>\nKantilal Mehta vs. Commissioner of Police, AIR<\/a> 1989 Supreme Court 491<br \/>\nand the recent judgment dated 28.03.2011 passed by the Division Bench<br \/>\nof this Court (Coram : S.K. Mukhopadhaya C.J. and J.B. Pardiwala, J.)<br \/>\nin Letters Patent Appeal No.2732 of 2010 in Special Civil<br \/>\nApplication No.9492 of 2010 <a href=\"\/doc\/1733522\/\">(Aartiben vs. Commissioner of Police)<\/a><br \/>\nwhich would squarely help the detenue.\n<\/p>\n<p>3.\tLearned<br \/>\nAssistant Government Pleader submitted that registration of FIR&#8217;s<br \/>\nwould go to show that the detenue had, in fact, indulged into such<br \/>\nactivities, which can be said to be disturbing the public health and<br \/>\npublic order and in view of sufficient material before the detaining<br \/>\nauthority to pass the order of detention, no interference is called<br \/>\nfor by this Court in exercise of its power under Article 226 of the<br \/>\nConstitution of India.\n<\/p>\n<p>4.\tHaving<br \/>\nheard the rival submissions of the parties and perused the record of<br \/>\nthe case, I am of the view that FIR&#8217;s registered under the Bombay<br \/>\nProhibition Act alone cannot be said to be sufficient enough to<br \/>\narrive at subjective satisfaction to the effect that the activities,<br \/>\nas alleged, are prejudicial to the public order or lead to<br \/>\ndisturbance of public order.  There has to be nexus and link for such<br \/>\nactivities with disturbance of the public order.  On careful perusal<br \/>\nof the material available on record and the ratio laid down by the<br \/>\nApex Court in the case of Piyush Kantilal Mehta<br \/>\n(supra) and the recent judgment dated 28.03.2011 passed by the<br \/>\nDivision Bench of this Court (Coram:S.K. Mukhopadhaya C.J. and J.B.<br \/>\nPardiwala, J.) in Letters Patent Appeal No.2732 of 2010 in<br \/>\nSpecial Civil Application No.9492 of 2010 <a href=\"\/doc\/1733522\/\">(Aartiben vs. Commissioner<br \/>\nof Police), I<\/a> am of the view that the activities of the<br \/>\ndetenue cannot be said to be in any manner prejudicial to the public<br \/>\norder and therefore, the order of detention passed by the detaining<br \/>\nauthority cannot be sustained and is required to be quashed and set<br \/>\naside.\n<\/p>\n<p>5.\tIn<br \/>\nthe result, the petition is allowed.  The order of detention dated<br \/>\n08\/07\/2011 is quashed and set aside.  The detenue, is ordered to be<br \/>\nset at liberty forthwith, if not required in connection with any<br \/>\nother case.  Rule is made absolute, accordingly.
