Therefore, though the submission canvassed by learned<br \/>\n\tAssistant Government Pleader appears to be attractive the Court is<br \/>\n\tinclined to call upon the respondents to answer this petition.\n<\/p>\n<p>At<br \/>\n\tthis stage, learned Assistant Government Pleader Ms.Jhaveri has<br \/>\n\tsubmitted that the matter be posted on 25.04.2011 and meantime, she<br \/>\n\twill receive appropriate instructions qua issues raised by the<br \/>\n\tpetitioners. Request is accepted, with specific observation that the<br \/>\n\tAuthorities shall have to answer and pass-on appropriate instruction<br \/>\n\tas to under which authority of law, Taluka Development Officer could<br \/>\n\tbe said to have issue notice, which is not addressed to the<br \/>\n\tparticular society.\n<\/p>\n<p>\tRespondent &#8211; Authorities may place on record, if there is any<br \/>\n\tresolution, notification, circular, if any, empowering the Taluka<br \/>\n\tDevelopment Officer to issue notice, who has admittedly been given<br \/>\n\tpowers by way of delegation for registration of the societies for<br \/>\n\tthe area, in case there is no such authorisation is available then<br \/>\n\tprima-facie, it can be said that Panchayat is not mindful of the<br \/>\n\tprovision of Section &#8211; 4 of the Gujarat Cooperative Societies<br \/>\n\tAct. All the matters are posted on 25.04.2011.\n<\/p>\n<p>At<br \/>\n\tthis stage, Learned Assistant Government Pleader Ms.Jhaveri has<br \/>\n\tsubmitted that delegation of the powers are given to Taluka<br \/>\n\tPanchayat. If it was so, then, the Taluka Panchayat acting through<br \/>\n\tTaluka Development Officer would not have mentioned in his notice<br \/>\n\tthat the proposals are to be forwarded to Assitant District<br \/>\n\tRegistrar, District Panchayat.\n<\/p>\n<p>\tThere is no delegation so far as the registration of societies by<br \/>\n\tTaluka Development Officer or Taluka Panchayat. However, if it is<br \/>\n\tso, requisite notification be placed on record.
