SANKARAN, J.\n                    ---------------------------\n                     B.A. No. 290 of 2010\n               ------------------------------------\n          Dated this the 22nd day of February, 2010\n\n                           O R D E R\n<\/pre>\n<p>      When the Bail Application came up for hearing on<\/p>\n<p>11.02.2010, the following order was passed:<\/p>\n<blockquote><p>               &#8220;This is an application for anticipatory<\/p>\n<p>         bail under Section 438 of the Code of<\/p>\n<p>         Criminal Procedure.       The petitioners are<\/p>\n<p>         accused Nos.2 to 4 in Crime No.8 of 2010<\/p>\n<p>         of   Melukavu    Police    Station,   Kottayam<\/p>\n<p>         District.\n<\/p><\/blockquote>\n<blockquote><p>               2.    The offences alleged against the<\/p>\n<p>         petitioners are under Sections 294(b), 323<\/p>\n<p>         and 326 read with Section 34 of the Indian<\/p>\n<p>         Penal Code.\n<\/p><\/blockquote>\n<blockquote><p>               3.    The prosecution case is that on<\/p>\n<p>         3.1.2010, the de facto complainant was<\/p>\n<p>         attacked by the accused persons with sticks<\/p>\n<p>         and hands.      The de facto complainant<\/p>\n<p>         sustained fracture on his left leg.       It is<\/p>\n<p>         submitted that the fracture is attributable to<\/p>\n<p>         the assault made by accused No.1.         It is<\/p>\n<p>         submitted that accused No.1 was arrested<\/p>\n<p>         and he was later released on regular bail. It<\/p>\n<p>         is also submitted that the overt acts alleged<\/p>\n<p>         against the petitioners are not attributable<\/p>\n<p>         to the grievous injury sustained by the de<\/p>\n<p>         facto complainant.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">B.A. No. 290 of 2010              2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                   4.   Taking into account the facts and<\/p>\n<p>             circumstances of the case, I am of the view<\/p>\n<p>             that before disposing of the Bail Application,<\/p>\n<p>             an opportunity should be given to the<\/p>\n<p>             petitioners    to    appear      before   the<\/p>\n<p>             investigating officer. Accordingly, there will<\/p>\n<p>             be a direction to the petitioners to appear<\/p>\n<p>             before the investigating officer at 9 A.M. on<\/p>\n<p>             16.2.2010 and 17.2.2010.       The petitioners<\/p>\n<p>             shall produce copy of the order before the<\/p>\n<p>             investigating officer.\n<\/p><\/blockquote>\n<blockquote><p>                   Post on 22.2.2010.\n<\/p><\/blockquote>\n<blockquote><p>                   It is submitted by the learned Public<\/p>\n<p>             Prosecutor that the petitioners will not be<\/p>\n<p>             arrested until further orders in connection<\/p>\n<p>             with Crime No.8 of 2010 of Melukavu Police<\/p>\n<p>             Station.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                   Hand over copy to both sides.&#8221;<\/p><\/blockquote>\n<p>      2. It is submitted by the learned counsel for the petitioners<\/p>\n<p>and the learned Public Prosecutor that the petitioners have<\/p>\n<p>complied with the direction contained in the order dated<\/p>\n<p>11.02.2010.\n<\/p>\n<p>      3.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p><span class=\"hidden_text\">B.A. No. 290 of 2010               3<\/span><\/p>\n<p>the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioners, the officer in charge of the police station shall release<\/p>\n<p>them on bail on their executing bond for Rs.15,000\/- each with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The petitioners       shall    report    before    the<br \/>\n              investigating officer between 9 A.M and 11 A.M.<br \/>\n              on alternate Mondays, till the final report is filed<br \/>\n              or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The      petitioners   shall    appear    before   the<br \/>\n              investigating officer for interrogation as and when<br \/>\n              required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioners shall not try to influence the<br \/>\n              prosecution    witnesses    or   tamper   with   the<br \/>\n              evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioners shall not commit any offence or<br \/>\n              indulge in any prejudicial activity while on bail.<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n              mentioned above, the bail shall be liable to be<br \/>\n              cancelled.<\/p><\/blockquote>\n<p>        The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                      K.T.
