JUSTICE PRADEEP KUMAR\n                         ------\n      For the Appellant:          Mr. Ananda Sen\n      For the Insurance Company : Mr. Alok Lal\n                         ------\n\n6\/ 16.03.2010<\/pre>\n<p>      Heard learned counsel for the appellant and learned counsel<br \/>\n            for the respondent-Insurance Company and with their consent this<br \/>\n            appeal is disposed of at the admission stage.\n<\/p>\n<p>                   We are not issuing any notice to the claimants as because<br \/>\n            they will not be affected by the judgment and award, which is going<br \/>\n            to be passed.\n<\/p>\n<p>                   This appeal has been filed by the owner of the vehicle<br \/>\n            against the judgment and award passed by the Motor Vehicle<br \/>\n            Accident Claims Tribunal, Chaibasa in Compensation Case No. 22<br \/>\n            of 2007 whereby he has awarded a sum of Rs. 2,04,500\/- and<br \/>\n            directed the appellant-owner of the vehicle to pay the said<br \/>\n            compensation amount on the ground that the appellant-owner of<br \/>\n            the vehicle failed to produce the Insurance policy by which the<br \/>\n            vehicle was said to be insured with the respondent-Insurance<br \/>\n            Company.\n<\/p>\n<p>                   The claimants are the parents and minor brothers, who have<br \/>\n            claimed compensation on account of death of the deceased in an<br \/>\n            accident caused by a truck. The owner of the vehicle took the plea<br \/>\n            that the vehicle was insured with the Insurance Company. For<br \/>\n            better appreciation, we shall reproduce some of the paragraphs of<br \/>\n            the impugned judgment, which will speak itself. Paragraph 11 of the<br \/>\n            judgment reads as under:\n<\/p>\n<blockquote><p>                                        &#8220;11.        I find that O.P. No.1 has<br \/>\n                                  challenged that he is not insurer of the truck<br \/>\n                                  and if so the terms and conditions of policy is<br \/>\n                     to be complied and secondly O.P. No. 1 has<br \/>\n                    also challenged the validity of driving license of<br \/>\n                    the driver but on the record I find that neither<br \/>\n                    original insurance policy nor the driving license<br \/>\n                    have been proved by O.P. No. 2 &amp; 3, when the<br \/>\n<span class=\"hidden_text\">                    matter is under challenge then O.P. Nos. 2 &amp; 3<\/span><br \/>\n                    are required to prove there but all these are<br \/>\n                    lacking on the record and this is decided<br \/>\n                    accordingly.&#8221;\n<\/p><\/blockquote>\n<p>      The appellant-owner of the vehicle did not produce the<br \/>\nInsurance policy. The Tribunal, therefore, observed as under:\n<\/p>\n<blockquote><p>                          &#8220;As I have discussed above that O.P.<br \/>\n                    No. 2 owner and O.P. No. 3 driver although<br \/>\n                    appeared in this case have filed show cause<br \/>\n                    but they have not proved their contention<br \/>\n                    through evidence. The O.P. No. 1 Insurance<br \/>\n                    Company has challenged the insurance policy<br \/>\n                    and driving license of the driver. No paper has<br \/>\n                    been filed regarding driving license by O.P.<br \/>\n                    No. 3. So far the insurance is concerned it is<br \/>\n                    the onus of O.P. No. 2 owner to file the original<br \/>\n                    insurance paper and get it exhibited. But they<br \/>\n                    have failed to do so and this tribunal is bound<br \/>\n                    to act upon the evidence available on the<br \/>\n<span class=\"hidden_text\">                    record. Since O.P. no. 2 owner and O.P. No. 3<\/span><br \/>\n                    have failed to submit papers of insurance<br \/>\n                    policy and valid driving license so that liability<br \/>\n                    to pay compensation to claimants would<br \/>\n                    devolve upon O.P. No. 2 and Insurance<br \/>\n                    Company shall not be held liable in such cases<br \/>\n                    (Vimal Karla Vrs. Madhan Lal reported in<br \/>\n                    1996 ACJ 658). The driver is not necessary<br \/>\n                    party and owner of the truck may be held liable<br \/>\n                    (2008 ACJ 838).&#8221;<\/p><\/blockquote>\n<p>      Considering the aforesaid facts, the Tribunal assessed the<br \/>\ncompensation amount and directed the appellant-owner of the<br \/>\nvehicle to pay the said amount of compensation.\n<\/p>\n<p>      In the instant appeal, the appellant-owner of the vehicle<br \/>\nreiterated that the truck was insured with the respondent- Insurance<br \/>\nCompany. On 11.1.2010, the appeal was heard in part and Mr. Alok<br \/>\nLal, learned counsel appearing for the Insurance Company was<br \/>\ndirected to seek instruction as to whether the vehicle in question<br \/>\nwas insured with the respondent- Insurance Company. Today, Mr.<br \/>\nAlok Lal, learned counsel for the Insurance Company, on<br \/>\ninstruction, submitted that the vehicle was insured with the<br \/>\nInsurance company during the relevant date of accident. Admittedly<br \/>\nwhen the vehicle was insured with the Insurance Company, it was<br \/>\nhighly improbable and unjustified for the Insurance Company to<br \/>\nchallenge that the vehicle was not insured with it, without proper<br \/>\n            verification of their records. This practice must be stopped by the<br \/>\n           Insurance Companies. At the same time when the vehicle was<br \/>\n           insured then what prevented the appellant-owner of the vehicle<br \/>\n           from producing either the original insurance policy or copy of the<br \/>\n           insurance policy. It was equal responsibility of the owner to produce<br \/>\n           before the Tribunal the insurance policy in support of his defence<br \/>\n           that the vehicle was insured.\n<\/p>\n<p>                 In the light of aforesaid finding, we are of the view that the<br \/>\n           entire compensation amount shall have to be paid by the<br \/>\n           respondent- Insurance Company. So far interest part is concerned,<br \/>\n           the appellant-owner must be saddled with the liability of payment<br \/>\n           of interest because of inaction on his part in not producing the<br \/>\n           policy before the Tribunal.\n<\/p>\n<p>                 This appeal is, therefore, allowed and we modify the<br \/>\n           operative part of the judgment by holding that the Insurance<br \/>\n           Company shall pay the entire compensation and the interest, as<br \/>\n           awarded by the tribunal, shall be paid by the appellant-owner of the<br \/>\n           vehicle.\n<\/p>\n<p>                                                                (M.
