THE PRINCIPAL   R.D.&amp; D.J.COLLEGE, MUNGER\n                             -----------\n<\/pre>\n<p>2   06.07.2010            Heard learned counsels for the petitioner and the<\/p>\n<p>                 respondent-University.\n<\/p>\n<p>                          The grievance of the petitioner is that her husband<\/p>\n<p>                 died in harness on 23rd April, 1996 while working on the post<\/p>\n<p>                 of University Professor, but the entire death-cum-retiral<\/p>\n<p>                 benefits have not been settled till date.<\/p>\n<p>                          It is submitted that the petitioner is receiving the<\/p>\n<p>                 family pension from the year 2003 in unrevised scale, and as<\/p>\n<p>                 such, she is entitled to the arrears of family pension with<\/p>\n<p>                 effect from the date of death of her husband on the correct<\/p>\n<p>                 scale of pay admissible to her husband at the time of his<\/p>\n<p>                 death.\n<\/p>\n<p>                          Mr. Anil Singh, learned counsel appearing for the<\/p>\n<p>                 respondent-University    submits    that    the   claims   of   the<\/p>\n<p>                 petitioner shall be considered without delay as per law.<\/p>\n<p>                          In the above circumstances, learned counsel for the<\/p>\n<p>                 petitioner submits that for expeditious disposal of the<\/p>\n<p>                 pending claims as highlighted in this writ application,<br \/>\n            petitioner proposes to file a representation before the<\/p>\n<p>           respondent no.6.\n<\/p>\n<p>                    In    such    view    of   the   matter,    in   case     such<\/p>\n<p>           representation stating details of unpaid claims is filed by the<\/p>\n<p>           petitioner within a period of six weeks from today along with<\/p>\n<p>           the certified copy of the present order as also the copy of the<\/p>\n<p>           relevant documents, if any, in support of the claim, the<\/p>\n<p>           grievances of the petitioner raised in the representation shall<\/p>\n<p>           be considered in accordance with law expeditiously preferably<\/p>\n<p>           within   a    period   of   four    months   on     receipt   of   such<\/p>\n<p>           representation so that the grievances of the petitioner could<\/p>\n<p>           be settled without delay and upon consideration the admitted<\/p>\n<p>           dues found payable could also be paid to the petitioner along<\/p>\n<p>           with interest permissible under the rules.<\/p>\n<p>                    The writ application stands disposed of with the<\/p>\n<p>           above observations\/directions.\n<\/p>\n<\/p>\n<pre>Manish\/-                                       (Shailesh Kumar Sinha,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Smt.Asha Kanth vs The State Of Bihar &amp;Amp; Ors on 6 July, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.10279 of 2010 SMT.ASHA KANTH W\/O LATE PROF.
