Instead of disposing of the application, we propose to hear out the appeal itself with the consent of the parties.\n<\/p>\n<p>2. This mandamus appeal is at the instance of an unsuccessful writ petitioner and is directed against order dated 25th January, 2006 passed by a learned Single Judge thereby dismissing the writ application with costs.\n<\/p>\n<p>3. There is no dispute that the writ petitioner\/appellant is an industrial consumer of electricity. In the year 1999 before coming into operation of the Electricity Act, 2003 a dispute arose as regards the bill sent by the West Bengal State Electricity Board; as a result, the writ petitioner filed a regular suit disputing the said bill. The suit was decreed but on an appeal preferred by the West Bengal State Electricity Board that decree was set aside.\n<\/p>\n<p>4. During the pendency of the appeal preferred by the State Electricity Board, the parties entered into an agreement and the consumer agreed that the meter should be sent to the Chief Electrical Inspector in terms of the then provision of the Electricity Act, 1910. Subsequently, a writ application was also filed alleging inaction on the part of the West Bengal State Electricity Board and such writ application was disposed of by a learned Single Judge by directing the State Electricity Board to consider the writ application as the representation and to pass a reasoned order disposing of such representation. Pursuant to the direction given by the learned Single Judge, the S.E. and Circle Manager, Hooghly District, passed a reasoned order holding that the original alleged defective matter which had been changed during the pendency of the proceedings will be sent to the Chief Electrical Inspector, Kolkata for testing and the writ petitioner should bear the necessary cost of testing as per law.\n<\/p>\n<p>5. The Chief Electrical Inspector has found that the meter being T.G.M. No. 0212 which was sent to him was not defective. In the present writ application the only grievance of the writ petitioner is that it was the duty of the West Bengal State Electricity Board not only to send the said meter being T.G.M. No. 0212 but also the current transformer and potential transformer which, according to the writ petitioner, are part of the electrical meter as per definition of the meter provided in the Indian Electricity Rules, 1956.\n<\/p>\n<p>6. The learned Single Judge, as pointed out earlier, was of the view that the writ application was filed with mala fide intention after the writ petitioner has lost in the civil suit and therefore, dismissed the application with costs.\n<\/p>\n<p>7. Being dissatisfied, the writ petitioner has come up with the present mandamus appeal.\n<\/p>\n<p>8. Mr. Roy Chowdhury, the learned Advocate appearing on behalf of the appellant, has raised a pure question of law in support of the present mandamus appeal. According to Mr. Roy Chowdhury, his client being undisputedly an industrial consumer, the current transformer and the potential transformer are part of the meter and even if there was no defect in the meter being T.G.M. No. 0212, such fact did not conclusively determine whether the entire systems were defective or not. Mr. Roy Chowdhury contends that if high voltage electricity comes through defective current transformer or potential transformer, that will not show the exact consumption and therefore, even if the meter being T.G.M. No. 0212 which reflects the reading of the meter only will not show the correct recording.\n<\/p>\n<p>9. Mr. Mitra, the learned Advocate appearing on behalf of the West Bengal State Electricity Board Distribution Company Limited, has however, opposed the aforesaid contention advanced by Mr. Roy Chowdhury and has contended that this plea was never taken earlier and as such, the learned Single Judge rightly concluded that the application was filed with mala fide intention. Mr. Mitra points out that the writ petitioner has not even paid subsequent consumption charge even after supply of new meter and therefore, according to Mr. Mitra, the learned Single Judge rightly rejected the writ application with costs.\n<\/p>\n<p>10. Therefore, the only question that falls for determination in this mandamus appeal is whether it was the duty of the West Bengal State Electricity Board also to send the current transformer and potential transformer along with the earlier meter that has since been changed.\n<\/p>\n<p>11. After hearing the Learned Counsel for the parties and after going through definition of &#8220;meter&#8221; given in Rule 2(aca) of the Indian Electricity Rules, 1956, we find that the &#8220;meter&#8221; means a set of integrating instruments used to measure the amount of electrical energy supplied or the quantity of electrical energy contained in the supply, in a given time, which include whole current meter and metering equipment such as current transformer, capacitor, voltage transformer or potential or voltage transformer with necessary wiring and accessories.\n<\/p>\n<p>12. In the case before us, the writ petitioner being undisputedly an industrial consumer, high voltage of the electricity is supplied to the writ petitioner and such electricity passes to the meter after being stepped down by current transformer or potential or voltage transformer, as the case may be. Therefore, even if in the meter being T.G.M. No. 0212 there was no defect, if there was defect in current transformer or potential transformer by which the electricity supplied to the writ petitioner is stepped down, the reading reflected in T.G.M. No. 0212 will not describe the actual consumption of the electricity of the writ petitioner. As pointed out earlier, the parties agreed that the meter should be sent to the Chief Electrical Inspector and if, according to the definition of &#8220;meter&#8221; as given in the Indian Electricity Rules, 1956, such meter includes the current transformer and potential transformer, we find substance in the contention of Mr. Roy Chowdhury that those should also be tested particularly because in the case before us, the writ petitioner is supplied with high voltage electricity which is required to be stepped down before the actual recording is indicated in the electrical meter.\n<\/p>\n<p>13. In the case before us, there is no dispute that the current transformer and potential transformer were not sent to the Chief Electrical Inspector for examination. Therefore, no fruitful purpose will be served unless those are also examined for ascertaining the correct picture. We find that the learned Single Judge overlooked this aspect of the matter.\n<\/p>\n<p>14. We, therefore, set aside the order passed by the learned Single Judge and allow the writ application to this extent that the State Electricity Board will also send the current transformer and the potential transformer attached to the electrical system of the writ petitioner to the Chief Electrical Inspector and ultimate decision will depend upon the result of examination of those two parts of the meter-system.\n<\/p>\n<p>15. The State Electricity Board is directed to immediately send the current transformer and potential transformer to the then Chief Electrical Inspector preferably within one month from today and will take final decision on the basis of the report that may be submitted by the then Chief Electrical Inspector.\n<\/p>\n<p>16. We are given to understand by Mr. Mitra, the learned Advocate appearing on behalf of the West Bengal State Electricity Distribution Company Limited, a sum of Rs. 5,68,000\/- is due and payable by the writ petitioner for the consumption of electricity for the subsequent period.\n<\/p>\n<p>17. Mr. Roy Chowdhury submits that his client will pay the amount but having regard to the aforesaid amount he prays for instalments.\n<\/p>\n<p>18. After taking into consideration the fact that the matter is unnecessary pending for a long time for not sending those two parts of the meter, we permit the writ petitioner to pay the amount of Rs. 5,68,000\/- towards the consumption charge including late payment surcharge.\n<\/p>\n<p>19. The writ petitioner is directed to make the payment of the aforesaid amount by three equal monthly instalments. First of such instalment to be paid by the end of June, 2007 and the other two by the end of July and August, 2007.\n<\/p>\n<p>20. There will be unconditional injunction restraining the State Electricity Board from disconnecting the supply of electricity to the writ petitioner till 30th June, 2007 and if the writ petitioner complies with the direction for payment as per this order, the same should continue until the disposal of the dispute by the Chief Electrical Inspector in accordance with law. The payment made pursuant to this order will abide by the final decision of the Chief Electrical Inspector.\n<\/p>\n<p>21. The writ petitioner will also make payment of the current bill submitted by the West Bengal State Electricity Board.\n<\/p>\n<p>22. In view of disposal of the appeal itself, the connected application for appropriate order being CAN No. 780 of 2007 has become infructuous and the same is disposed of accordingly.\n<\/p>\n<p>Let a xerox certified copy of this order, if applied for, be supplied to the parties within a week from the date of making of such application on compliance with requisite formalities.\n<\/p>\n<p>B.
