BASANT, J.\n\n              -------------------------------------------------\n\n               CRL.M.C.NO.1612 &amp; 1613  OF 2007\n\n              -------------------------------------------------\n\n               Dated this the  24th day of May, 2007\n\n\n\n                                    ORDER\n<\/pre>\n<p>      These   applications   are   filed   by   the   common   petitioner<\/p>\n<p>who   faces     allegations   under   the   provisions   of   the   Kerala<\/p>\n<p>Abkari   Act.       According   to   the   petitioner,   he   is   absolutely<\/p>\n<p>innocent.       Totally   false   and   vexatious   allegations   have   been<\/p>\n<p>raised   against   the   petitioner   with   oblique   motive.       The<\/p>\n<p>petitioner   had   filed   complaints   of   corruption   against   the<\/p>\n<p>officials and that is the reason why such false allegations have<\/p>\n<p>been raised against the petitioner.      The petitioner is willing<\/p>\n<p>to surrender before the learned Magistrate.   This Court as per<\/p>\n<p>the   order   dated   23\/5\/07   in   Crl.M.C.No.1605\/07   had   issued<\/p>\n<p>directions   in   favour   of   the   petitioner   in   a   similar   case.<\/p>\n<p>Identical directions may be issued in  favour of the petitioner,<\/p>\n<p>it is submitted.\n<\/p>\n<\/p>\n<p>      2.       It   is   not   necessary   to   advert   to   the   facts   in   detail.<\/p>\n<p>Crl.M.C.No.1605\/07   was   dismissed   subject   to   observations.<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO.1612 &amp; 1613  OF 2007  -: 2 :-<\/span><\/p>\n<p>Similar   observations  can be made  in   favour   of the petitioner  in<\/p>\n<p>these Crl.M.Cs. also.\n<\/p>\n<\/p>\n<p>        3.       In   the   result,   these   Crl.M.Cs.   are   dismissed;   but   with<\/p>\n<p>the specific observation that if the petitioner appears before the<\/p>\n<p>learned   Magistrate   and   applies   for   bail   after   giving   sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Magistrate   must   proceed   to   pass   appropriate   orders   on   merits<\/p>\n<p>and expeditiously on the date of surrender itself.<\/p>\n<p>        4.
