The petitioner, therefore, ordered<br \/>\nhis dismissal from service. This order of dismissal dated 11.1.96 was<br \/>\nchallenged by the respondent before the Labour Court by raising<br \/>\ndispute.  The Labour Court also found that the misconduct was proved<br \/>\nagainst the respondent.  The Labour Court was, however, pleased to<br \/>\ncome to the conclusion that the order of dismissal was<br \/>\ndisproportionate to the charges proved against the respondent and the<br \/>\norder of was therefore set aside.  The respondent was ordered to be<br \/>\nreinstated in service with continuity  and with 60 per cent backwages<br \/>\nand punishment of withholding of one increment without future effect<br \/>\nwas ordered to be imposed.\n<\/p>\n<p>3.\tIn<br \/>\nthe facts of the present case, the award of the Labour Court cannot<br \/>\nbe sustained in its entirety.   The respondent had committed<br \/>\nmisconduct which was proved against him. Directing his reinstatement<br \/>\nwith 60 per cent backwages was therefore not proper.  The learned<br \/>\nadvocate for the respondent, however, submits that pursuant to the<br \/>\naward passed by the Labour Court, the respondent  was actually<br \/>\nreinstated in service in the year 2001  and subsequently, at his<br \/>\nrequest he was permitted to voluntarily retire from service on 31st<br \/>\nAugust 2003.  He submitted that the respondent was keeping<br \/>\nindifferent health on account of which he had to seek early<br \/>\nretirement.  In view of this development and the petitioner itself<br \/>\nhas accepted  the notice of retirement of the respondent, to revive<br \/>\nthe order of dismissal would be inequitable.  The respondent,<br \/>\nhowever, cannot get away without any punishment.  As noted earlier,<br \/>\ndirection for payment of 60 per cent backwages is wholly untenable<br \/>\nand   the same is required to be set aside.\n<\/p>\n<p>4.\tAccordingly,<br \/>\nthe direction for payment of 60 per cent backwages is set aside.  In<br \/>\naddition to setting aside the said direction, it is provided that the<br \/>\nrespondent will be visited with penalty of withholding of two<br \/>\nincrements with future effect.  Reinstatement with  continuity in<br \/>\nservice is  however maintained.  The impugned award of the Labour<br \/>\nCourt is accordingly modified. The petition is allowed to the above<br \/>\nextent.
