Justice S.SIRI JAGAN\n\n Dated :02\/08\/2010\n\n O R D E R\n                       S.SIRIJAGAN, J.\n                 ------------------------------------------\n                 WP (C) No. 24088 of 2010\n                 ---------------------------------------\n            Dated this the 2nd day of August, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>                         &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>     The petitioner is a teacher by profession and he is<\/p>\n<p>running educational institutions.                    He is holding an<\/p>\n<p>account with the first respondent.                    He had availed a<\/p>\n<p>vehicle loan from the 3rd respondent Bank. For payment of<\/p>\n<p>the installment amounts of that loan the petitioner has<\/p>\n<p>issued an ECS mandate to the respondents 1 and 2 for<\/p>\n<p>payment from out of his account. The mandate has been<\/p>\n<p>accepted by respondents 1 and 2 and the 3rd respondent.<\/p>\n<p>Alleging that ECS mandate has not been properly<\/p>\n<p>complied with, the petitioner approached the Banking<\/p>\n<p>ombudsman, the 4th respondent herein. After obtaining<\/p>\n<p>the version of the Bank and stating the reasons mentioned<\/p>\n<p>by the first respondent Bank therein, the Banking<\/p>\n<p>Ombudsman      finally      rejected        the      complaint of  the<\/p>\n<p>petitioner in the following words:-\n<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><br \/>\nWP (C) No. 24088 of 2010<\/p>\n<p>     &#8220;Considering the details of the complaint and the Bank&#8217;s<br \/>\n     version, no case of deficiency of service as alleged against<br \/>\n     South Indian Bank is substantiate.    HDFC Bank has also<br \/>\n     reimbursed charges of Rs.454\/- levied to the complainant&#8217;s<br \/>\n     loan account&#8221;.\n<\/p>\n<\/p>\n<p>     2. The petitioner&#8217;s grievance is that this is not proper<\/p>\n<p>consideration by the Banking ombudsman and therefore<\/p>\n<p>Exhibit P5 is liable to be quashed and the 4th respondent is<\/p>\n<p>liable to reconsider the complaint of the petitioner to pass<\/p>\n<p>fresh orders giving reasons as to why the petitioner&#8217;s<\/p>\n<p>complaint is not maintainable.\n<\/p>\n<p>      3. I have heard the counsel for the respondents 1 and<\/p>\n<p>2 as well as the counsel for the 3rd respondent. On a<\/p>\n<p>reading of Exhibit P5, I am not satisfied that the 4th<\/p>\n<p>respondent has discharged his duty properly .                  In the<\/p>\n<p>petitioner&#8217;s complaint the 4th respondent is bound to first<\/p>\n<p>find whether the ECS mandate has been complied with by<\/p>\n<p>the first respondent and if not, the reasons of the Bank is<\/p>\n<p>sufficient for not complying with that mandate. What the<\/p>\n<p>Banking ombudsman has done in this case is simply to<\/p>\n<p>quote the version of the Bank and to accept the same<\/p>\n<p><span class=\"hidden_text\">                               3<\/span><br \/>\nWP (C) No. 24088 of 2010<\/p>\n<p>without giving his reasons for accepting the Bank&#8217;s<\/p>\n<p>version and rejecting the contentions of the petitioner. He<\/p>\n<p>is expected to consider the contentions of both and give<\/p>\n<p>reasons as to why he accepted the contention of anyone of<\/p>\n<p>the parties.        That has not been done by Exhibit P5.<\/p>\n<p>Therefore Exhibit P5 is bad for non application of mind<\/p>\n<p>and non-furnishing of reasons by the 4th respondent.<\/p>\n<p>Accordingly, Exhibit P5 is quashed.\n<\/p>\n<p>      The 4th respondent is directed to pass fresh orders on<\/p>\n<p>the complaint filed by the petitioner after affording an<\/p>\n<p>opportunity of being heard to all parties concerned. In his<\/p>\n<p>order the Banking Ombudsman shall give reasons as to<\/p>\n<p>why he has accepted contention of either party.
