                   petitioner as well as learned counsel for<\/p>\n
                   the State.\n<\/p>\n
                            Though     multiple    prayer    have    been<\/p>\n
                   made     in   the    writ      application   for     a<\/p>\n
                   direction to the respondents in respect of<\/p>\n
                   his promotion to the post of class III,<\/p>\n
                   learned senior counsel for the petitioner,<\/p>\n
                   at the time of arguments, has confined the<\/p>\n
                   relief    sought     for    from   this   Court     by
\n                    2<\/span><\/p>\n
petitioner        in     respect       of     time        bound<\/p>\n
promotion     in       the    scale    and    benefits       of<\/p>\n
A.C.P. scheme only.\n<\/p>\n
        It    is       not     disputed       that    having<\/p>\n
worked under the work charged establishment<\/p>\n
for certain length of time, petitioner was<\/p>\n
regularized       in    the     regular      establishment<\/p>\n
with effect from 16.02.1999.<\/p>\n
        Learned         senior        counsel      for      the<\/p>\n
petitioner has placed reliance on Memo No.3<\/p>\n
\/ P.A.R – 03-1\/92\/5000 dated 21st September,<\/p>\n
1992, copy whereof is annexed as Annexure-<\/p>\n
16 with the rejoinder of the petitioner to<\/p>\n
the   counter      affidavit.         This   memo    of     the<\/p>\n
Government    shows          that   the   employees,        who<\/p>\n
were taken into regular establishment from<\/p>\n
work charged establishment, are also held<\/p>\n
entitled for time bound promotion in terms<\/p>\n
of Resolution No. 10770 dated 30.12.1981.<\/p>\n
        It appears that the petitioner had<\/p>\n
earlier moved this Court umpteen times with<\/p>\n
a number of claims. Finally, on the basis<\/p>\n
of the order passed by a Division Bench in<\/p>\n
his   Letters      Patent      Appeal     No.17      of    2005<\/p>\n
disposed     of    on    12.01.2005,         he   filed     the<\/p>\n
representation which has been rejected by
\n                   3<\/span><\/p>\n
the Superintending Engineer, Ganga Bridge<\/p>\n
Circle No.II, Road Construction Department<\/p>\n
vide Annexure-1. In the impugned order it<\/p>\n
has     been    held       that     petitioner     is   not<\/p>\n
entitled for his promotion to the post of<\/p>\n
Class III. However, it has been observed<\/p>\n
that the petitioner can raise his claim for<\/p>\n
grant of benefits of A.C.P. scheme with the<\/p>\n
present        Department         under    which   he   is<\/p>\n
working.\n<\/p>\n
         Learned Additional Advocate General<\/p>\n
No.V submits that in view of the memo of<\/p>\n
the Government dated 21.09.1992, petitioner<\/p>\n
can raise a claim for grant of time bound<\/p>\n
promotion        counting         length     of    service<\/p>\n
rendered         under        the         work     charged<\/p>\n
establishment. Similarly, he submits that<\/p>\n
for grant of benefit of A.C.P. scheme also,<\/p>\n
he    can   raise      a   claim     with    the   present<\/p>\n
Department       which      shall    be    considered   in<\/p>\n
view of the Government decision and shall<\/p>\n
be dealt with and disposed of accordingly.<\/p>\n
A.A.G. No. V informs that the petitioner is<\/p>\n
at present working under the Rural Works<\/p>\n
Department and is posted under respondent<\/p>\n
no.7.\n<\/p>\n
                       4<\/span><\/p>\n
              In     the    circumstances,          this    writ<\/p>\n
     application is disposed of with a direction<\/p>\n
     to the petitioner to file a representation<\/p>\n
     before respondent no.7, Executive Engineer,<\/p>\n
     Vigilance     Division-3        (Hqr.),    Rural      Works<\/p>\n
     Department, Patna for grant of time bound<\/p>\n
     promotion in the scale as well as for grant<\/p>\n
     of    benefit    of    A.C.P.    scheme.       Respondent<\/p>\n
     no.7     is      directed        to     consider       the<\/p>\n
     representation of the petitioner, if filed<\/p>\n
     for the above claims, taking into account<\/p>\n
     the Government decisions, as may be found<\/p>\n
     applicable in the case of the petitioner,<\/p>\n
     and dispose of the same in accordance with<\/p>\n
     law    preferably      within    a    period    of    three<\/p>\n
     months    from    the    date    of    filing     of    the<\/p>\n
     representation.\n<\/p>\n
              It goes without saying that if the<\/p>\n
     petitioner is found entitled for grant of<\/p>\n
     benefits of the same, consequential orders<\/p>\n
     for release of monetary benefits shall also<\/p>\n
     be issued within that very time.<\/p>\n
