MANJORA, P.S.\n                  BIHARIGANJ, MADHEPURA.\n                                           Versus\n                               The State Of Bihar &amp; Ors .\n                                         -----------\n<\/pre>\n<p>3   01\/07\/2011            Admitted position with regard to the present<\/p>\n<p>                  dispute is that the petitioner was a probationer<\/p>\n<p>                  undergoing training in what is known as Nath Nagar<\/p>\n<p>                  Police Training Centre in the district of Bhagalpur. The<\/p>\n<p>                  post on which the petitioner was appointed was the post<\/p>\n<p>                  of Sub Inspector of Police.\n<\/p>\n<p>                          During the course of training, one of the trainee<\/p>\n<p>                  Sub Inspector of Police died during the course of<\/p>\n<p>                  treatment at I.G.I.M.S., Patna.      Because of rumour<\/p>\n<p>                  floating on the campus as to the circumstance of death of<\/p>\n<p>                  the trainee, it led to violence and act of indiscipline<\/p>\n<p>                  which was indulged by many a persons who were<\/p>\n<p>                  undergoing training at the relevant time. Petitioner was<\/p>\n<p>                  also one of the probationers.      When the matter was<\/p>\n<p>                  enquired into, it transpired that the petitioner had a role<\/p>\n<p>                  in instigating and leading other probationers to indulge in<\/p>\n<p>                  serious acts of indiscipline due to the death in question.<br \/>\n<span class=\"hidden_text\">                   -2-<\/span><\/p>\n<p>        The    above    pre-background     compelled   the<\/p>\n<p>authorities to zero down on the persons who were<\/p>\n<p>responsible for such unruly acts and it was decided in<\/p>\n<p>the wisdom of the authorities that they should invoke<\/p>\n<p>powers under Rule 668-A of the Bihar Police Manual,<\/p>\n<p>1978. The powers are there to terminate the services of<\/p>\n<p>probationers. The termination order issued was order of<\/p>\n<p>termination, simplicitor.\n<\/p>\n<p>        This Court does not have to go into catena of<\/p>\n<p>decisions with regard to the right of a probationer to<\/p>\n<p>continue on the post as well as the right of an employer<\/p>\n<p>to terminate them during the period of probation,<\/p>\n<p>whatever be the evolution in service jurisprudence. This<\/p>\n<p>basic principles have not undergone any drastic change.<\/p>\n<p>Probationers can be terminated if the employer is not<\/p>\n<p>satisfied for whatever reason with regard to their<\/p>\n<p>conduct, behaviour or the quality of training they have<\/p>\n<p>acquired during the period of probation.<\/p>\n<p>        Termination order led to filing of earlier writ<\/p>\n<p>application. Petitioner was also one of the persons who<\/p>\n<p>moved in C.W.J.C. No. 17523 of 2009. The learned<\/p>\n<p>Single Judge decided to remand the matter back to the<br \/>\n<span class=\"hidden_text\">                   -3-<\/span><\/p>\n<p>authorities for re-consideration on the ground urged at<\/p>\n<p>the Bar that there is violation of Article 14 of the<\/p>\n<p>Constitution of India in matter of award of punishment.<\/p>\n<p>According to the petitioner discrimination had been<\/p>\n<p>practiced while terminating the services of some which<\/p>\n<p>includes the petitioner as well as retaining some even<\/p>\n<p>though according to him they were as much culpable, if<\/p>\n<p>not in the same boat.\n<\/p>\n<p>        The learned Single Judge relying on a decision<\/p>\n<p>rendered by the Hon&#8217;ble Supreme Court in the case of<\/p>\n<p>Man Singh Vs. state of Haryana and others reported<\/p>\n<p>in (2008) 12 S.C.C., 331 with special emphasis on<\/p>\n<p>paragraphs 20, 21 and 22 remanded the writ application<\/p>\n<p>for re-consideration.        The order passed after re-<\/p>\n<p>consideration is contained in annexure-1 which is under<\/p>\n<p>challenge in the present writ application.        Petitioner<\/p>\n<p>raises similar plea including the additional plea that the<\/p>\n<p>observation of the High Court in the earlier order has not<\/p>\n<p>been taken into consideration while insisting with the<\/p>\n<p>order of termination simplicitor.\n<\/p>\n<p>        Submission      of     learned   Senior    Counsel<\/p>\n<p>representing the petitioner is that the allegation against<br \/>\n<span class=\"hidden_text\">                   -4-<\/span><\/p>\n<p>him is that he only instigated or took part in agitation just<\/p>\n<p>like many others. It was a case of mob action and it is<\/p>\n<p>unfair to put the entire blame on a handful of trainees.<\/p>\n<p>        However, there are materials to show that it is<\/p>\n<p>not that the respondents have picked up persons for<\/p>\n<p>action at random. They have zerowed down on the<\/p>\n<p>mischief makers or the leaders after some exercise.<\/p>\n<p>        Since the petitioner was not a permanent<\/p>\n<p>employee and was only a probationer, this Court has<\/p>\n<p>certain reservation in applying the principle of Article 14<\/p>\n<p>of the Constitution of India as envisaged by the Supreme<\/p>\n<p>Court in the case of Man Singh (Supra) which was not<\/p>\n<p>passed in a similar matter.       That case related to a<\/p>\n<p>permanent employee and not a probationer who is liable<\/p>\n<p>for termination during the period of probation as per<\/p>\n<p>extent rule.\n<\/p>\n<p>        There is a very detailed consideration which has<\/p>\n<p>been given by the Deputy Inspector General of Police<\/p>\n<p>(Personnel) to the issue and in the opinion of this Court<\/p>\n<p>indulgence of the kind which the petitioner is looking for<\/p>\n<p>will be detrimental to the interest of the disciplined force<\/p>\n<p>to which the petitioner had only been recruited and was<br \/>\n<span class=\"hidden_text\">                           -5-<\/span><\/p>\n<p>        at the threshold of training.\n<\/p>\n<p>                The status of the petitioner as probationer,<\/p>\n<p>        therefore, does give power to the respondents to<\/p>\n<p>        terminate his services which is a termination order<\/p>\n<p>        simplicitor.\n<\/p>\n<p>                There is no merit in this writ application.
