No.2801\/2009-H\n                 ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n           Dated this the 3rd day of November, 2009\n\n                      J U D G M E N T\n<\/pre>\n<p>    The petitioner is aggrieved by the refusal of the<\/p>\n<p>respondent to regularise the period of suspension of the<\/p>\n<p>petitioner  and  the  non-fixation  of  his  pay  and  other<\/p>\n<p>retirement benefits in accordance with the pay revision<\/p>\n<p>orders.   The petitioner seeks for a direction to the<\/p>\n<p>respondents to grant full pension and to disburse the<\/p>\n<p>entire amount of D.C.R.G to the petitioner after correctly<\/p>\n<p>fixing the pay and retiral benefits on the basis of an<\/p>\n<p>order to be passed under Rule 56B of Part I K.S.R.<\/p>\n<p>    2.   The   petitioner  herein   had   been  working  as<\/p>\n<p>Assistant Teacher in an Aided U.P. School, namely, Perambra<\/p>\n<p>A.U.P  School  and  he  retired   from  the  school  as   on<\/p>\n<p>31\/03\/2008.    He   was  placed   under  suspension  during<\/p>\n<p>19\/12\/2003  to  07\/09\/2004  consequent  to  a   disciplinary<\/p>\n<p>proceedings initiated against him.    The said disciplinary<\/p>\n<p>action was   finalised  as  per  Ext.P1  order  whereby  the<\/p>\n<p>punishment of barring of two increments with cumulative<\/p>\n<p>effect was imposed.\n<\/p>\n<p>    3.   Apart   from   the   disciplinary  proceedings,   a<\/p>\n<p>vigilance case has also been registered against him as<\/p>\n<p>W.P.(C). No.2801\/2009<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>C.C.No.14\/2004 which is pending before the Vigilance Court,<\/p>\n<p>Kozhikode.\n<\/p>\n<p>     4.      In view of the fact that the period of suspension<\/p>\n<p>has not been regularised, he could not get the benefits of<\/p>\n<p>pay revision, and the other retirement benefits have also<\/p>\n<p>not been sanctioned to him.\n<\/p>\n<p>     5.      In the counter affidavit, the stand taken is that<\/p>\n<p>the petitioner was suspended pursuant to the registration<\/p>\n<p>of the vigilance case against him.       The allegation against<\/p>\n<p>him is that he tried to make false entries in the ledger<\/p>\n<p>sheets and Board sheets related to P.F account for the<\/p>\n<p>period from 1984-85 to 1995-96.       Suspension was revoked as<\/p>\n<p>per   Ext.P2     and  he  was   reinstated in  service  without<\/p>\n<p>prejudice to the vigilance action pending against him.       It<\/p>\n<p>is the case of the respondents that since the vigilance<\/p>\n<p>case is pending, the period of suspension has not been<\/p>\n<p>regularised and hence, his pay was not revised as per G.O.<\/p>\n<p>(P).No.145\/06.       Provisional  pension  was  sanctioned  by<\/p>\n<p>Assistant Educational Officer, Perambra.      It is also stated<\/p>\n<p>that the retirement benefits could not be sanctioned as the<\/p>\n<p>period of suspension was not regularised.<\/p>\n<p>     6.      The question is whether the period of suspension<\/p>\n<p>can   be    regularised   only  after   the conclusion  of  the<\/p>\n<p>vigilance case pending against him.\n<\/p>\n<p>W.P.(C). No.2801\/2009<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>     7.      According to the petitioner it is Rule 56B of Part<\/p>\n<p>I K.S.R that will apply.      It is therefore contended that in<\/p>\n<p>terms of Rule 56B specific order has to be passed by the<\/p>\n<p>competent authority without waiting for the conclusion of<\/p>\n<p>the   vigilance      case.   Rule    56B obliges  the   competent<\/p>\n<p>authority to pass an order:\n<\/p>\n<p>(a) regarding the pay and allowances to be paid to the<\/p>\n<p>officer      for    the  period   of   suspension   ending   with<\/p>\n<p>reinstatement        or  the   date    of   his   retirement   on<\/p>\n<p>superannuation, as the case may be; and<\/p>\n<p>b) whether or not the said period shall be treated as a<\/p>\n<p>period spent on duty.\n<\/p>\n<p>Sub-rule (6) is also important, which states as follows:-<\/p>\n<blockquote><p>                   &#8220;Where  suspension   is  revoked pending<\/p>\n<p>             finalisation of the disciplinary or court<\/p>\n<p>             proceedings, any order passed under sub-rule<\/p>\n<\/blockquote>\n<blockquote><p>             (i)     before   the     conclusion   of   the<\/p>\n<p>             proceedings, against the officer shall be<\/p>\n<p>             reviewed    on  its   own   motion  after  the<\/p>\n<p>             conclusion    of  the    proceedings,  by  the<\/p>\n<p>             authority   mentioned   in  sub-rule  (i)  who<\/p>\n<p>             shall    make  an  order    according  to  the<\/p>\n<p>             provisions of sub-rule (3) or sub-rule (5),<\/p>\n<p>             as the case may be.&#8221;\n<\/p><\/blockquote>\n<p>W.P.(C). No.2801\/2009<br \/>\n<span class=\"hidden_text\">                                -:4:-<\/span><\/p>\n<p>In that view of the matter, it is upto the competent<\/p>\n<p>authority      to    pass  an   order   with  regard  to   the<\/p>\n<p>regularisation of the period of suspension and how the<\/p>\n<p>period shall be treated.       The same cannot be kept pending<\/p>\n<p>till the finalisation of the vigilance case against him.<\/p>\n<p>In the disciplinary proceedings, punishment has already<\/p>\n<p>been imposed on him.\n<\/p>\n<p>     8.      The next question is regarding the claim of the<\/p>\n<p>petitioner for disbursal of D.C.R.G and other benefits.<\/p>\n<p>The matter is governed by Rule 3A(a) of Part III K.S.R.<\/p>\n<p>Going by the said rule, no gratuity or death-cum-retirement<\/p>\n<p>gratuity     shall    be  paid  to   the pensioner  until  the<\/p>\n<p>conclusion of such proceeding and the issue of final orders<\/p>\n<p>thereon.     The issue is also covered by the decision of this<\/p>\n<p>Court in <a href=\"\/doc\/1166497\/\">Sreepath Bhatt v. Tahsildar<\/a> [2004(3)KLT SN.17<\/p>\n<p>C.No.22]. It was held thus:-\n<\/p>\n<blockquote><p>                   &#8220;Learned Government Pleader points out<\/p>\n<p>             that in terms of R.3A(a) of Part III K.S.R,<\/p>\n<p>             he is eligible to get a provisional pension<\/p>\n<p>             only.    It is seen from R.3A(a) Part III<\/p>\n<p>             K.S.R that what is expressly prohibited by<\/p>\n<p>             that Rule is payment of D.C.R.G.  Of course,<\/p>\n<p>             the rule says that the retired person shall<\/p>\n<p>             be paid a provisional pension.   Since there<\/p>\n<p>             is no statutory prohibition against payment<\/p>\n<p>W.P.(C). No.2801\/2009<br \/>\n<span class=\"hidden_text\">                                 -:5:-<\/span><\/p>\n<p>             of other benefits due to the petitioner, I<\/p>\n<p>             am inclined to direct the respondents to pay<\/p>\n<p>             the    petitioner  not   only the   provisional<\/p>\n<p>             pension   admissible    to him  but  also   all<\/p>\n<p>             amounts    other   than    Death-cum-Retirement<\/p>\n<p>             Gratuity, by way of terminal benefits.&#8221;<\/p><\/blockquote>\n<p>     9.      The learned counsel for the petitioner further<\/p>\n<p>made a submission that going by Ext.P1, it can be seen that<\/p>\n<p>there is no allegation that the actions of the petitioner<\/p>\n<p>resulted in any loss.       In the absence of any loss caused to<\/p>\n<p>the Government, it is contended that, no recovery can be<\/p>\n<p>effected against the D.C.R.G as evident from R.3(a) Part<\/p>\n<p>III K.S.R. Note 2 thereon.       It is therefore, submitted that<\/p>\n<p>the D.C.R.G cannot be withheld.\n<\/p>\n<p>     10. The said contention is not correct in the light of<\/p>\n<p>R.3A(a) of Part III K.S.R.       It is a case where the judicial<\/p>\n<p>proceeding is pending against the petitioner.       The question<\/p>\n<p>is whether in the light of the pendency of the vigilance<\/p>\n<p>case    before    the   Vigilance   Court, the  D.C.R.G  can  be<\/p>\n<p>disbursed to him.        In the light of the express provision<\/p>\n<p>under     R.3A(a)      of Part III K.S.R, the same cannot be<\/p>\n<p>disbursed.\n<\/p>\n<p>     11. What remains is the regularisation of the period<\/p>\n<p>of suspension, sanction of arrears of salary consequent on<\/p>\n<p>pay revision and other retirement benefits, if any.        It is<\/p>\n<p>W.P.(C). No.2801\/2009<br \/>\n<span class=\"hidden_text\">                               -:6:-<\/span><\/p>\n<p>averred in para (5) of the counter affidavit that as no<\/p>\n<p>decision was taken to regularise the period of suspension,<\/p>\n<p>his pay      was   not  revised as  per G.O  (P)  145\/06  and,<\/p>\n<p>provisional       pension  was sanctioned  by  the   Assistant<\/p>\n<p>Educational Officer, Perambra.\n<\/p>\n<p>     12. Therefore,      there  will be  a  direction  to the<\/p>\n<p>competent     authority   among the  respondent to  see  that<\/p>\n<p>appropriate orders are passed as regards regularisation of<\/p>\n<p>the period of suspension and thereafter, regarding the<\/p>\n<p>sanction of revised pay in terms of G.O.(P).No.145\/2006 and<\/p>\n<p>the claim for payment of retirement benefits excluding<\/p>\n<p>D.C.R.G.      Orders as above shall be passed within a period<\/p>\n<p>of two months from the date of receipt of a copy of this<\/p>\n<p>Judgment.     Depending upon the same, the provisional pension<\/p>\n<p>sanctioned will also be revised and the benefits like<\/p>\n<p>retirement      benefits  other  than  D.C.R.G including   the<\/p>\n<p>arrears consequent on the pay revision orders in force<\/p>\n<p>prior to his date of retirement will be disbursed.<\/p>\n<p>     The writ petition is allowed as above.    No costs.<\/p>\n<p>                            (T.R.
