Mr.Kakkad, Advocate, waives service of Rule<br \/>\n     on behalf of the Respondent.       In   the   facts   and<br \/>\n     circumstances of the case, rule is finally heard today.\n<\/p>\n<p>     By the Application Exhibit 60       for   raising<br \/>\n     preliminary    issue    regarding    jurisdiction,    the<br \/>\n     petitioner-State requested the trial court to raise and<br \/>\n     determine the issue as to jurisdiction as a preliminary<br \/>\n     one. The learned Judge rejected the said application<br \/>\n     Exhibit 60, holding, inter alia, that the Court was of<br \/>\n     the view that prima facie, the Court had jurisdiction to<br \/>\n     entertain and try the suit and at that stage, it could<br \/>\n     not decide. The issue with regard to jurisdiction could<br \/>\n     be raised and decided as a preliminary issue having<br \/>\n     regard to the provisions of Order 14 Rule 2(2) of the<br \/>\n     Code of Civil Procedure. It, inter alia, provides that<br \/>\n     where issue, both of law and fact, arises in the Suit and<br \/>\n     the Court is of the opinion that the case or any part<br \/>\n     thereof may be disposed of on any issue of law only, it<br \/>\n     may try that issue first if that issue relates to the<br \/>\n     jurisdiction of the Court.      In the instant case, the<br \/>\n     issue with regard to jurisdiction of the Court is<br \/>\n     specifically raised.    There are no reasons recorded by<br \/>\n     the learned trial Judge while dismissing the Application<br \/>\n     Exhibit 60 as to on what basis the Court believed, prima<br \/>\n     facie even, that the Court has jurisdiction to try the<br \/>\n     suit.   It is the specific case of the petitioner-State<br \/>\n that the plaintiff could seek relief, as is sought in the<br \/>\npresent suit, under the provisions of the Gujarat Service<br \/>\nTribunal Act, 1972. The learned Judge has not referred<br \/>\nto all the provisions of the Gujarat Service Tribunal<br \/>\nAct. There is, therefore, clear non-application of mind<br \/>\nin this regard.     In the facts and circumstances of the<br \/>\ncase, the revision application deserves to be allowed and<br \/>\nis accordingly allowed.\n<\/p>\n<p>In the result, the Rule is made absolute with no<br \/>\norder as to costs. The order passed below Application<br \/>\nExhibit 60 is hereby quashed and set aside. Application<br \/>\nExhibit 60 stands granted.     Accordingly, the learned<br \/>\ntrial   court   is directed to try the issue as to<br \/>\njurisdiction as a preliminary issue.\n<\/p>\n<p>5th August, 1997( D.G.
