AGP for Respondent(s) : 2, 4, \nRULE SERVED BY DS\nfor Respondent(s) : 2 -\n3. \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition, the detenu has challenged the order of District<br \/>\nMagistrate, Bhavnagar dated 4.4.2010 passed in exercise of powers<br \/>\nunder Section 3(2) of the Prevention of Black Marketing &amp;<br \/>\nMaintenance of Supplies of Essential Commodities Act, 1980 ( P.B.M.<br \/>\nAct  for short), detaining him.\n<\/p>\n<p>2.\t\tThe<br \/>\nbrief facts of the case are that on 27.1.2010, inspection of the<br \/>\ngrocery shop of the detenu was carried out by the Authority and he<br \/>\nwas found to be involved in the unauthorized activity of storing and<br \/>\nselling of sugar, which was purchased by the detenu from one<br \/>\nAnwarbhai Hajijusabbhai Sarvaiya, who is running a fair price shop,<br \/>\nat Shihor. Therefore, the detenu came to be detained by the Authority<br \/>\nvide impugned order.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate for the detenu has invited my attention to the order of<br \/>\ndetention dated 4.4.2010 and the grounds stated therein. Learned<br \/>\nAdvocate has contended that there was no material before the<br \/>\ndetaining authority except couple of statements recorded and relied<br \/>\non which can be said to be sufficient material to detain the<br \/>\npetitioner in the commission of the offence. He has further submitted<br \/>\nthat the detaining authority has mechanically passed the order<br \/>\nwithout proper application of mind.\n<\/p>\n<p>3.\t\tHe<br \/>\nhas further submitted that the impugned order deserves to be quashed<br \/>\nand set aside.  In support of his case, learned Advocate has relied<br \/>\nupon a decision in the case of  Smt.\n<\/p>\n<p>Shashi Agrawal v. State of U.P.  reported<br \/>\nin A.I.R. 1988 SC 596 wherein it has been held<br \/>\nthat before passing the order of detention, there must be credible<br \/>\ninformation or cogent reasons apparent on the record that the detenu,<br \/>\nif enlarged on bail, would act prejudicially to the interest of<br \/>\npublic order.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate has further submitted that the detaining authority has not<br \/>\nsupplied legible copies of the documents on the basis of which the<br \/>\nimpugned order of detention was passed. Learned Advocate has<br \/>\nsubmitted that since legible copies of the documents were not<br \/>\nsupplied, the right of the detenu to make an effective representation<br \/>\nagainst his detention has been infringed.  In support of this case,<br \/>\nhe has relied upon a decision of this Court in the case of<br \/>\n <a href=\"\/doc\/706656\/\">Pokhrajbhai Sohanbhai Chandel v. District Magistrate,<br \/>\nSurat &amp; ors.<\/a>  reported<br \/>\nin 1991 (2) G.L.R. 753<br \/>\nwherein it has been held that if the documents supplied to the detenu<br \/>\nare illegible then the right of the detenu to make effective<br \/>\nrepresentation is infringed, and hence, the order of detention is<br \/>\nliable to be set aside.\n<\/p>\n<p>4.\t\tLearned<br \/>\nA.G.P. Ms.<br \/>\nMehta for the respondent State and learned Central Govt. Counsel Mr.<br \/>\nShaikh for respondent   Union of India have supported the order of<br \/>\ndetention as well as the grounds stated therein and has contended<br \/>\nthat the authority has passed the impugned order after taking into<br \/>\nconsideration all the facts and circumstances of the case, and hence,<br \/>\nno case is made out calling for interference of this Court.\n<\/p>\n<p>5.\t\tHeard<br \/>\nlearned Advocate for the parties. On perusal of the documents on<br \/>\nrecord, it appears that,  there was no material before the detaining<br \/>\nauthority to arrive at the conclusion that the detenu was likely to<br \/>\nindulge into similar activities. Hence, it appears that the detaining<br \/>\nauthority has mechanically passed the order without proper<br \/>\napplication of mind. In view of the principle laid down in the case<br \/>\nof  Smt. Shashi<br \/>\nAgrawal&#8217;s<br \/>\n(supra), the order passed by the detaining authority is<br \/>\nunsustainable in the eye of law and deserves to be quashed and set<br \/>\naside on this ground itself.\n<\/p>\n<p>6.\t\tApart<br \/>\nfrom the above, the impugned order of detention also deserves to be<br \/>\nquashed and set aside on the ground that the documents supplied by<br \/>\nthe detaining authority were illegible on account of which the<br \/>\nvaluable right of the detenu to make an effective representation<br \/>\nunder Article 22(5) of the Constitution has been infringed. Hence,<br \/>\nconsidering the principle laid down in the case of  Pokhrajbhai<br \/>\nSohanbhai Chandel&#8217;s  (supra), the impugned order of<br \/>\ndetention deserves to be quashed and set aside on this ground also.\n<\/p>\n<p>7.\t\tIn<br \/>\nview of the above discussion the petition is allowed. The impugned<br \/>\norder of detention passed by District Magistrate, Bhavnagar dated<br \/>\n4.4.2010 is hereby quashed and set aside. The detenu is ordered to be<br \/>\nset at liberty forthwith, if he is not required in connection with<br \/>\nany other case by the Authority.
