The said scale was<br \/>\nrevised to Rs.700-1800 with effect from 1st July 1979.<br \/>\nThereafter in pursuance of   a Circular, petitioner applied, was<br \/>\ncalled for interview and was selected for the post of Manager. The<br \/>\npetitioner took charge as Manager on 3rd January 1983.\n<\/p>\n<p>3.\tNew<br \/>\nBank of India (Officer) Service Regulation, 1982 came into effect<br \/>\nfrom 1st January 1983. According to the regulations the<br \/>\nBank was supposed to  categorize the existing posts\/scales. The<br \/>\nrespondent Bank therefore categorized the grade\/scale of the<br \/>\nofficers of the bank and published seniority list. As per the<br \/>\nseniority list, 78 officers were placed in grade\/scale-II with effect<br \/>\nfrom 1.2.1983 and those officers are shown from serial nos.197 to\n<\/p>\n<p>274. According to the petitioner his name should have been shown in<br \/>\nthe grade\/scale II at serial no.262 of the said list. However, his<br \/>\nname was shown at serial no.612 of the seniority list for JMG<br \/>\ngrade\/scale I of the respondent Bank. According to the petitioner<br \/>\nthereafter also case of about 30 such officers who were also<br \/>\nsimilarly  to the petitioner were considered by the respondent bank<br \/>\nin the year 1989 and onwards. It is contended that though the<br \/>\npetitioner has represented many times and even though in similar<br \/>\ncases Bank had extended such benefits, the petitioner was denied the<br \/>\nsame.\n<\/p>\n<p>4.\tIn<br \/>\nshort, the petitioner has challenged the promotion policy. The issued<br \/>\nraised in this petition is squarely covered by the decision in the<br \/>\ncase of K.B. Sharma and another Vs. Union of India and another,<br \/>\nreported in (1998)9 SCC 38. Para 7 thereof reads as under;\n<\/p>\n<p>7.\tA<br \/>\nplain reading of the aforesaid provisions clearly demonstrates that<br \/>\nneither the seniority of the appellants in the erstwhile Bank before<br \/>\nthe taking over of the same nor their services as Assistant Manager,<br \/>\nassuming the same to be a promotion are being wiped off in any manner<br \/>\nso as to hold the provisions of the Promotion Policy to be<br \/>\ndiscriminatory. On the other hand the provisiosn for a determination<br \/>\nof itner se seniority under the Promotion Policy provide for<br \/>\nadditional weightage for the service rendered by an employee as<br \/>\nAssistant Manager in the erstwhile Bank. We also find sufficient<br \/>\nforce in the contention of Mr. Reddy, learned  Additional Solicitor<br \/>\nGeneral that prior to taking over of the Bank the Accountants and<br \/>\nAssistant Managers were in the same grade scale and the Assistant<br \/>\nManagers were getting an additional allowance of Rs.75 p.m. for the<br \/>\nonerous nature of duty they were performing and, therefore, the same<br \/>\nis not a promotion Stricto sensu.  But even otherwise the Promotional<br \/>\nPolicy having taken care of giving additional weightage for the<br \/>\nservices rendered by him as Assistant Manager in addition to the<br \/>\nlength of service for determination of seniority in the cadre of<br \/>\nJunior Management Grade Scale I neither any part of the service thus<br \/>\nrendered by an employee has been ignored or can the Policy be<br \/>\nattached as discriminatory. We are, therefore, in agreement with the<br \/>\nDivision Bench of the High Court, of the considered opinion that the<br \/>\nprovisions of the Promotional Policy sought to be challenged  in<br \/>\nthese proceedings are constitutionally valid and there is no legal<br \/>\ninfirmity in the same. Even in the matter of laying down the Policy<br \/>\nand criteria for promotion the very Promotional Policy, more<br \/>\nparticularly clause 11 thereof provides for different weightage for<br \/>\nvarious factors and as such in laying down the Policy all relevant<br \/>\nfactors have been taken into consideration.&#8221;\n<\/p>\n<p>5.\tIt<br \/>\nis  held in the aforesaid decision that a plain reading of<br \/>\nRegulations 18(2) &amp; (5) of the 1982 Regulations and clauses 5.1,<br \/>\n5.5. 6.2 and 71. of the Promotion Policy clearly demonstrates that<br \/>\nneither the seniority of the appellants in the erstwhile Bank before<br \/>\nthe taking over of the same nor their services as Assistant Manager,<br \/>\nassuming the same to be a promotion were being wiped off in any<br \/>\nmanner so as to hold the provisions of the Promotion Policy to be<br \/>\ndiscriminatory. Hence the petition is dismissed.
