In support of his<br \/>\n\tsubmission, he relied upon the order dated 26.11.2007 passed by the<br \/>\n\tcoordinate Bench of this Court (Coram: A.S. Dave, J.) in Special<br \/>\n\tCivil Application No.29158 of 2007.  As such, if the petitioner is<br \/>\n\tdesirous to pay the penalty, such indulgence can be granted and the<br \/>\n\tsame, in any case, would not aversely prejudice the rights of the<br \/>\n\trespondents.\n<\/p>\n<p>Hence,<br \/>\n\tthe following directions :-\n<\/p>\n<p>(a)\t\tThe<br \/>\n\tpetitioner shall pay the penalty of Rs.83,184\/- in two parts namely;<br \/>\n\tthat after the payment of Rs.40,000\/- towards penalty, the<br \/>\n\tauthorization shall be restarted and the remaining amount of<br \/>\n\tRs.43,184\/- shall be paid in equal instalments of Rs.10,000\/- each<br \/>\n\tevery month from the next month of restarting the authorization and<br \/>\n\tthe last instalment would be of Rs.13,184\/-.\n<\/p>\n<p>\t(b)\t\tThe<br \/>\n\torder passed by the State Government shall stand modified to the<br \/>\n\taforesaid extent.\n<\/p>\n<p>\tThe<br \/>\n\tpetition is partly allowed to the aforesaid extent. Rule made<br \/>\n\tabsolute accordingly.
