PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.Sajjan Singh,for the petitioner.\n<\/p>\n<p>Mr. LK Purohit, for the respondents.\n<\/p>\n<p>     Heard learned counsel for the parties.\n<\/p>\n<p>     The petitioner submitted an application under Section<\/p>\n<p>11 of the Arbitration and Conciliation Act, 1996 (hereinafter<\/p>\n<p>referred to as the Act of 1996) before this Court which was<\/p>\n<p>registered    as     S.B.   Civil    Misc.     Arbitration   Application<\/p>\n<p>No.54\/2004. At that time, it came to the notice of the court<\/p>\n<p>that similar application was filed by the petitioner-applicant<\/p>\n<p>at Jaipur Bench.      The time was sought to know about the<\/p>\n<p>fate of the petition filed at Jaipur Bench and then it came to<\/p>\n<p>notice   of   this    Court     in       the   Arbitration   Application<\/p>\n<p>No.54\/2004 that the applicant clearly stated that he is no<\/p>\n<p>longer interested in the said application at Jaipur Bench. In<\/p>\n<p>view of the above, the arbitration application no.36\/2002<\/p>\n<p>filed at Jaipur Bench was dismissed by the order dated<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>4.2.2005.    After noticing above affairs, this court also<\/p>\n<p>noticed that the matter has already been sent to the<\/p>\n<p>committee constituted as per the clause no.23 of the<\/p>\n<p>contract between the parties         and matter was pending<\/p>\n<p>before that committee. Against the proceeding before the<\/p>\n<p>standing    committee,   the       present   petitioner-applicant<\/p>\n<p>submitted his objection asking them not to proceed with the<\/p>\n<p>arbitral proceedings because the matter was pending before<\/p>\n<p>this Court in petitioner&#8217;s above arbitration applications.<\/p>\n<p>This court also observed that an application was filed<\/p>\n<p>seeking direction under Section 11(6) of the Act of 1996<\/p>\n<p>opposing the proceedings of the committee under condition<\/p>\n<p>no.23 and this court observed that, that was not in the<\/p>\n<p>spirit of the provisions of the Act of 1996. In these facts,<\/p>\n<p>the arbitration application no.54\/2004 was disposed of by<\/p>\n<p>this court at principal seat on 4th March, 2005 with the<\/p>\n<p>direction to both the parties to appear before the duly<\/p>\n<p>constituted committee in the office of Secretary to the<\/p>\n<p>Government in Irrigation Department, Rajasthan Jaipur on<\/p>\n<p>18th April, 2005 and direction was given to the Secretary to<\/p>\n<p>the Government, Irrigation Department to fix the date for<\/p>\n<p>further proceeding in arbitration proceedings as far as<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>possible within a period of three months. It was specifically<\/p>\n<p>observed that in case either party fails to cooperate in the<\/p>\n<p>matter, it will be open for the other party to seek necessary<\/p>\n<p>directions under Section 11(6) by moving appropriate<\/p>\n<p>application.\n<\/p>\n<p>     The petitioner now has submitted this application<\/p>\n<p>under Section 11(6) of the Act of 1996 seeking relief for<\/p>\n<p>setting aside the ex-parte decision given by the empowered<\/p>\n<p>committee.     The relief claimed in the petition for setting<\/p>\n<p>aside the decision of the empowered committee is beyond<\/p>\n<p>the scope of Section 11(6) of the Act of 1996 because of the<\/p>\n<p>fact that a decision given by empowered committee is a<\/p>\n<p>decision given under the contract and that cannot be<\/p>\n<p>challenged under any of the provisions under Section 11 of<\/p>\n<p>the Act of 1996 including under sub-section (6) of Section<\/p>\n<p>11 of the Act of 1996. The sub-section (6) of Section 11 of<\/p>\n<p>the Act of 1996 is reproduced as under: &#8211;\n<\/p>\n<p>           &#8220;(6)     Where,     under    an    appointment<br \/>\n           procedure agreed upon by the parties, &#8211;\n<\/p>\n<blockquote><p>                  (a) A party fails to act as required<br \/>\n                  under that procedure; or\n<\/p><\/blockquote>\n<blockquote><p>                  (b) The parties, or the two appointed<br \/>\n                  arbitrators, fail to reach an agreement<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>                  expected     of    them    under     that<br \/>\n                  procedure; or\n<\/p><\/blockquote>\n<blockquote><p>                  (c) A person, including an institution,<br \/>\n                  fails to perform any function entrusted<br \/>\n                  to him or it under that procedure,<br \/>\n                  A party may request the Chief Justice<br \/>\n                  or any person or institution designated<br \/>\n                  by him to take the necessary measure,<br \/>\n                  unless     the    agreement     on    the<br \/>\n                  appointment procedure provides other<br \/>\n                  means for securing the<br \/>\n                  appointment.&#8221;\n<\/p><\/blockquote>\n<p>      It is clear from the said provision that it deals with<\/p>\n<p>certain     contingencies   where   the   designated   judge<\/p>\n<p>designated by the Chief Justice of the High Court can pass<\/p>\n<p>appropriate order obviously so as the arbitral proceedings<\/p>\n<p>may be completed in accordance with law and it is not a<\/p>\n<p>provision wherein any award passed or decision taken by<\/p>\n<p>the competent committee can be set aside.<\/p>\n<p>      In view of the above reasons, this petition has no<\/p>\n<p>merit and the same is hereby dismissed.\n<\/p>\n<\/p>\n<p>                                     [PRAKASH TATIA], J.\n<\/p>\n<p>cpgoyal\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur M\/S Nav Bharat Buildcon (P) Ltd vs State &amp; Ors on 5 January, 2010 1 S.B.
