Rohtas at Sasaram\n                                                            ...petitioner.\n                                       Versus\n                 THE STATE OF BIHAR                         opposite party.\n                                            -----------\n<\/pre>\n<p>2   15.09.2010              Heard the parties.\n<\/p>\n<p>                            In a criminal prosecution registered under<\/p>\n<p>                 sections 414, 272, 273\/34 of the Indian penal Code as also<\/p>\n<p>                 under section 47 (a) of the Bihar Excise Act, three FIR<\/p>\n<p>                 named accused persons namely Ramayan Tiwary, Md.<\/p>\n<p>                 Golden and Akbar were apprehended by the police with a<\/p>\n<p>                 Scorpio vehicle. From the seized vehicle in question about<\/p>\n<p>                 720 Ltrs. Of country made liquor were seized by the police.<\/p>\n<p>                            It is submitted that admittedly the country made<\/p>\n<p>                 liquor in question has not been recovered either from the<\/p>\n<p>                 possession or from the house of the petitioner.               The<\/p>\n<p>                 petitioner has been arrayed in the category of accused on the<\/p>\n<p>                 basis of statement made by co-accused persons before the<\/p>\n<p>                 police. It is also submitted that name of the petitioner has<\/p>\n<p>                 been disclosed by the co-accused persons because of<\/p>\n<p>                 personal animosity. The petitioner is stated to be in judicial<\/p>\n<p>                 custody since 27.7.2010.        It is further highlighted that<\/p>\n<p>                 petitioner is a patient of AIDS and was under going<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>           treatment in the hospital.\n<\/p>\n<p>                     Taking into consideration the aforesaid facts and<\/p>\n<p>           circumstances of the case, the above named petitioner is<\/p>\n<p>           directed to be enlarged on bail on furnishing bail bond of<\/p>\n<p>           Rs. 10,000\/-(ten thousand) with two sureties of like amount<\/p>\n<p>           each to the satisfaction of S.D.J.M, Bikramganj , Rohtas, in<\/p>\n<p>           connection with Nasriganj (Rajpur) P.S.
