Mr.A.;.;  V  appearing<\/p>\n<p>for    the petitioner is not<br \/>\nthe owne\ufb01of  mas&#8217; much as a suit<\/p>\n<p>for &#8216;c\u00a7_.eel.a.1&#8217;a!&#8217;:.io:2,.    the petitioner has been<\/p>\n<p>   the matter went up to the Apex Court:\n<\/p>\n<p> has con\ufb01rmed the judgment and<\/p>\n<p>k  . decree of the Trial Court: holding that the petitioner is<\/p>\n<p>W  the Voemer of the property. Henm, the question of<\/p>\n<p>_  a notice would not arise.\n<\/p>\n<p>4. It is often said that before a person is hanged,<\/p>\n<p>at&#8217;<\/p>\n<p>he shouid be heard. Indeed that should be the \ufb02<\/p>\n<p><span class=\"hidden_text\">-4-<\/span><\/p>\n<p>tenor of principles of naturai justice. Indeed it is to be<br \/>\nnoticed that the petitioner was not a party :&#8217;<br \/>\nproceedings before the 2nd respondent.  =<br \/>\nAnnexure &#8216;A&#8217; stems from the order\u00bbipe_ssect   it it<\/p>\n<p>&#8216;D&#8217;. The petitioner, in the circumstances oirg1it.to_ <\/p>\n<p>been heard for whatever it is    been<br \/>\ndone. Consequently,<br \/>\n(al Fe   &#8221;\n<\/p>\n<pre>(b)     consequential dis-\n    A'  ismnexure 'A' stand\neqmed.:\u00bbi      \n<\/pre>\n<p>(c) &#8216;i&#8217;fie..  remitted to the 2nd<br \/>\n it \ufb02esh disposal in accordance<br \/>\nV. 47  H &#8216;vV&#8217;\ufb01.it:Vr&#8217;i.V&#8217;i:$\u00a7&#8217;i..&#8217;<br \/>\n.&#8217;   as well as respondent No.3 shall<br \/>\nit ~  before respondent No.2 on 6th July<\/p>\n<p>2009 and the 2&#8243;&#8221; respondent shall conclude<\/p>\n<p>the procmdings on or before 318&#8242; July 2009.\n<\/p>\n<p>Rule is issued and made absolute. j\/<br \/>\nZ<\/p>\n<p>5.
