Justice J.M.JAMES\n\n Dated :15\/12\/2006\n\n O R D E R\n                          J.M.JAMES, J.\n\n                           -------------------\n\n                       W.P.(C). 5216\/2006\n\n                           --------------------\n\n            Dated this  the 15th day of December, 2006\n\n\n                           JUDGMENT\n<\/pre>\n<p>              The writ petitioner is a retired employee of the<\/p>\n<p>second   respondent,   Panamaram   Service   Co-operative<\/p>\n<p>Bank,    Wayanad.    He   retired   on   health   reasons.     He  was<\/p>\n<p>entitled for retirement benefits, and he had been paid with<\/p>\n<p>gratuity.     On   acceptance,     he   endorsed   that   he   is   not<\/p>\n<p>entitled for any other further claims.<\/p>\n<p>      2.      The   learned   counsel   submits   that   such   an<\/p>\n<p>undertaking was only with  regard to the gratuity amount<\/p>\n<p>due to him.  It is further submitted that the writ petitioner<\/p>\n<p>is   entitled   for   Dearness   Allowance   from   1.7.1999   to<\/p>\n<p>30.4.2002   and   the   benefits   due   under   leave   surrender.<\/p>\n<p>The  writ petitioner  claims that the  amount of Rs.39,534\/-<\/p>\n<p>is due from the second respondent, bank, as per  Rule 189<\/p>\n<p>(3) and 198 of the Kerala Co-operative Societies Rules, in<\/p>\n<p>short &#8216;the Rules&#8217;.\n<\/p>\n<p>\nW.P.(C).5216\/2006<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>       3.    I heard the arguments advanced by both sides.<\/p>\n<p>The   first   respondent   had   heard   the   Secretary   and<\/p>\n<p>President of the Second respondent, bank,  as well as the<\/p>\n<p>writ petitioner.    The  Joint Registrar  also  considered  the<\/p>\n<p>Dearness   Allowance   entitlements   under   Rule   189(3)   of<\/p>\n<p>the Rules.   The representation of the writ petitioner was<\/p>\n<p>considered by the first respondent and on 27.5.2005, he<\/p>\n<p>passed   an   order   remanding   the   entire   matter   to   the<\/p>\n<p>second   respondent,   bank,   to   re-consider   afresh   the<\/p>\n<p>claims including  sanctioning and payment of quantum of<\/p>\n<p>Dearness Allowance prayed for, by the writ petitioner, as<\/p>\n<p>the   same   would   not   affect   so   much   of   the   financial<\/p>\n<p>position   of   the   bank.     Accordingly,   the   plea   of   the   writ<\/p>\n<p>petitioner was held to be allowed.\n<\/p>\n<\/p>\n<p>       4.    The   second   respondent,   thereafter   passed<\/p>\n<p>Ext.P2,   sanctioning   an   amount   of   Rs.30,709\/-.     The<\/p>\n<p>contention   of   the   writ   petitioner   is     that   the   amount<\/p>\n<p>sanctioned comes only  as a portion  of the  gratuity    and<\/p>\n<p>do   not   cover   the   Dearness   Allowance   for   the   period<\/p>\n<p>W.P.(C).5216\/2006<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>stated above as well as the payment for the surrender of<\/p>\n<p>the leave claimed by the petitioner.\n<\/p>\n<\/p>\n<p>      5.    The   counsel   for   the   petitioner   brought   to   my<\/p>\n<p>notice   about   the   scheme   that   had   been   evolved   for<\/p>\n<p>making payments to the voluntarily retired employees of<\/p>\n<p>the   second   respondent,   bank,   and   also   an   agreement<\/p>\n<p>entered  into  between  the  second respondent, bank, and<\/p>\n<p>the   employees   therein.     However,   the   counsel   for   the<\/p>\n<p>second   respondent   content   that   the   writ   petitioner   will<\/p>\n<p>not   come withing  the provisions of the scheme evolved<\/p>\n<p>between the second respondent as well as the employees<\/p>\n<p>therein, who had retired voluntarily.   The benefits     had<\/p>\n<p>to be given to such retired employees on voluntary basis,<\/p>\n<p>and the writ petitioner did not   retire voluntarily, but on<\/p>\n<p>health   reasons.     The   learned   counsel   for   the   writ<\/p>\n<p>petitioner, however, challenged the above contention and<\/p>\n<p>he drew my attention to paragraph  2 of Ext.P1  order of<\/p>\n<p>the first respondent dated 27.5.2005.<\/p>\n<p>      6.    After   hearing   both   sides   and   considering   the<\/p>\n<p>submissions   made   by   either   side,   without   entering   into<\/p>\n<p>W.P.(C).5216\/2006<\/p>\n<p><span class=\"hidden_text\">                                     4<\/span><\/p>\n<p>any discussions on the merit of the matter,   I dispose of<\/p>\n<p>this   writ   petition,   setting   aside   Ext.P2,   except   to   the<\/p>\n<p>extent of granting of  gratuity  amount, as stated therein.<\/p>\n<p>I further direct the second respondent, bank,  to hear the<\/p>\n<p>writ petitioner, consider all  contentions and pass orders<\/p>\n<p>afresh  in  accordance  with  Rule  189(3)  of  the  Rules  and<\/p>\n<p>other provisions of the law, together with the conditions<\/p>\n<p>contained   in   the   agreement,   if   any,   between   the   bank<\/p>\n<p>and its employees.\n<\/p>\n<\/p>\n<p>        7.
