Alum Hassan vs Commissioner Of Customs (Prev.), &#8230; on 21 December, 2000<\/div>\n<\/p>\n<pre><\/pre>\n<p>ORDER<\/p>\n<p>Mrs. Archana Wadhwa<\/p>\n<p>1. On matter being called, nobody appeared on behalf of the applicant. Accordingly, I have heard Shri a.K.Chattopadhyay, learned J.D.R. for the Revenue.\n<\/p>\n<p>2. The Stay Petition is for dispensing with the condition of predeposit of a penalty amount of Rs.10,000.00 imposed upon the applicant on the alleged finding that Indian Currency of Rs.63,000.00 recovered from the possession of the applicant has been smuggled by him from Bangladesh. For arriving at the above conclusion, the adjudicating authority has relied upon the fact that the Currency in question was recovered at a place which is 1.5 Km. from the Indian Border and the applicant could not satisfactorily explain the possession of the Indian Currency. Accordingly, the adjudicating authority has also confiscated the Indian Currency absolutely and has also imposed personal penalty upon the applicant.\n<\/p>\n<p>3. After giving my careful consideration to the issue involved, I find that inasmuch as Indian Currency of Rs.63,000.00 belonging to the applicant, has been confiscated absolutely by the authorities below, I dispense with the condition of predeposit of Rs.10,000.00(Rupees ten thousand) imposed as personal penalty upon the applicant and fix the main appeal on 16.1.2001.\n<\/p>\n<p>4.
