Justice ANTONY DOMINIC\n\n Dated :11\/10\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n            = = = = = = = = = = = = = = = =\n              W.P.(C) No. 30271 OF 2007 D\n            = = = = = = = = = = = = = = = =\n\n           Dated this the 11th October, 2007\n\n                    J U D G M E N T\n<\/pre>\n<p>    In this writ petition challenging the proceedings<\/p>\n<p>under  the   Securitisation    and   Reconstruction   of<\/p>\n<p>Financial Assets &amp; Enforcement of Security Interest<\/p>\n<p>Act, 2002 the only prayer made by counsel for the<\/p>\n<p>petitioner is for an instalment facility to enable him<\/p>\n<p>to make payments of the dues to the respondent Bank.<\/p>\n<p>    2. I heard the learned counsel for the respondent<\/p>\n<p>Bank also.\n<\/p>\n<p>    3. Having regard to the facts stated in the<\/p>\n<p>petition, I am inclined to direct the respondents to<\/p>\n<p>permit the petitioner to pay the dues in instalments as<\/p>\n<p>indicated hereunder:\n<\/p>\n<p>    The petitioner shall make a payment of Rs.50,000\/-<\/p>\n<p>before 1-11-2007.   Thereafter the balance amount due<\/p>\n<p>shall be paid by the petitioner in five equal monthly<\/p>\n<p>instalments payable on the 1st of every succeeding month<\/p>\n<p>commencing from 1st December, 2007.
