Their evidence supports the evidence of the<br \/>\ncomplainant &#8211; Police Inspector&#8217;.\n<\/p>\n<p>3.\t\tAfter<br \/>\nmaking the aforesaid observations in the judgment, learned Judge then<br \/>\ndrew a conclusion that &#8216;these witnesses are &#8216; interested<br \/>\nwitnesses&#8217; and, therefore, relied on their evidence<br \/>\nonly, the accused cannot be punished.&#8217;<\/p>\n<p>4.\t\tLearned<br \/>\nAPP next invited our attention to paragraph 24 wherein learned Judge<br \/>\nhas recorded that &#8216;in the Court itself, the complainant has<br \/>\nidentified the muddamal and the accused&#8217;, but thereafter, he has not<br \/>\ngiven weightage to the said observation and has committed an error in<br \/>\nrecording acquittal.\n<\/p>\n<p>4.1\t\tLearned<br \/>\nAPP also invited attention of the Court to the observations made by<br \/>\nlearned Additional Sessions Judge in paragraph 28 that the<br \/>\nprosecution has not recorded the statement of any other witness<br \/>\nexcept one Mansukhbhai.\n<\/p>\n<p>4.2\t\tLearned<br \/>\nAPP submitted that this observation is uncalled for in light of the<br \/>\nfact recorded by learned Additional Sessions Judge in the very next<br \/>\nparagraph in the first line of paragraph 29 learned Judge has<br \/>\nrecorded that &#8216;from the material produced before him and taking into<br \/>\nconsideration the facts of this case, the case of the prosecution is<br \/>\nthat on 17.8.2009 at 1.00 a.m. in the night, the incident took place<br \/>\nand the accused were apprehended by the police.&#8217;  In light of this,<br \/>\nobservation made by learned Additional Sessions Judge in paragraph 28<br \/>\nis uncalled for and learned Judge has misdirected himself on account<br \/>\nof that observation.\n<\/p>\n<p>5.\t\tThis<br \/>\nCourt is of the opinion that the matter requires consideration.<br \/>\nHence, this application is allowed.
