He suffered injuries in a motor<\/p>\n<p>accident which took place on 06.12.2004. He was an inpatient<\/p>\n<p>for a period of 15 days. He had suffered permanent partial<\/p>\n<p>disability also. Injuries included serious fracture. The Tribunal<\/p>\n<p>on the basis of the materials available before it, came to the<\/p>\n<p>conclusion that the claimant is entitled for an amount of<\/p>\n<p>Rs.93,215\/- as total compensation along with interest @ 7% per<\/p>\n<p>annum and proportionate cost.\n<\/p>\n<pre>     i)    Loss of earning                  :      Rs.10,000\/-\n\n     ii)   Expense for transportation:             Rs. 2,000\/-\n\n     iii)  Expense for extra\n           nourishment                      :      Rs. 2,000\/-\n\n     iv)   Damages to clothing              :      Rs.  500\/-\n\n     v)    Expense for treatment            :      Rs.10,950\/-\n\n     vi)   Expense for bystander            :      Rs. 1,600\/-\n\n     vii) Compensation for pain\n           and suffering                    :      Rs.15,000\/-\n\n<span class=\"hidden_text\">M.A.C.A No.1668 of 2009          2<\/span>\n\n      viii) Compensation for loss of\n            amenities                 :    Rs. 8,000\/-\n\n      ix)   Compensation for\n            disability                :    Rs.43,200\/-\n                                           ...................\n                            Total     :    Rs.93,250\/-\n                                           ...................\n\n<\/pre>\n<p>      2.    The appellant claims to be aggrieved by the impugned<\/p>\n<p>award.     The amount awarded does not represent just and<\/p>\n<p>reasonable compensation, argues counsel.            Called upon to<\/p>\n<p>explain the nature of the challenge which the appellant wants to<\/p>\n<p>mount against the impugned award, the learned counsel for the<\/p>\n<p>appellant contends that the Tribunal had erred in reckoning only<\/p>\n<p>10% as the reduction in earning capacity while computing the<\/p>\n<p>compensation even though 13% has been certified to be the<\/p>\n<p>extent of disability suffered by PW1 Doctor.<\/p>\n<p>      3.    The court below had adverted to Ext.A11 disability<\/p>\n<p>certificate in detail. The court below chose to accept that only<\/p>\n<p>10% is the extent of reduction in earning capacity and did not<\/p>\n<p>accept the percentage of disability certified in Ext.A11 which is<\/p>\n<p>proved by the oral evidence of PW1. We are unable to find any<\/p>\n<p>valid reason to interfere with the discretion exercised by the<\/p>\n<p>court below in accepting 10% as the reduction in earning<\/p>\n<p><span class=\"hidden_text\">M.A.C.A No.1668 of 2009           3<\/span><\/p>\n<p>capacity. Considering the nature of employment of the appellant<\/p>\n<p>as a salesman in a poultry farm, even assuming that the disability<\/p>\n<p>certified in Ext.A11\/PW1 were held to be correct, the acceptance<\/p>\n<p>of 10% as the reduction in earning capacity consequent to such<\/p>\n<p>disability does not, at any rate, warrant interference. We are not<\/p>\n<p>persuaded to invoke our appellate jurisdiction to interfere with<\/p>\n<p>the impugned award on that score. No other contentions are<\/p>\n<p>raised.\n<\/p>\n<p>      4. We have<\/p>\n<p>heard the learned counsel for the appellant. We are proceeding<\/p>\n<p>to dispose of the M.A.C.Appeal straightaway and it is not<\/p>\n<p>necessary to wait for issue and return of notice to the<\/p>\n<p>respondents.    We are, in these circumstances, satisfied that a<\/p>\n<p>lenient view can be taken and the delay can be condoned.<\/p>\n<p>     2.    Petition allowed.
